Switching from statutory to private health insurance during the German Referendariat: how the notice period works, when the binding period ends and how to avoid a gap.

If you are appointed as a probationary civil servant during your Referendariat (the German traineeship after the state exam), your existing health insurance needs a closer look. Civil servants are generally exempt from the statutory health insurance (GKV). A switch to private health insurance (PKV) is therefore often necessary, and two things matter most: the notice period and the timing of your health check.

Short answer: If you are voluntarily insured in the GKV, you terminate membership at the end of the second calendar month following your notice. The twelve-month binding period does not apply when membership ends by law. Avoid any gap in your health insurance. The exact conditions depend on your insurer. Last updated: October 2026.

The essentials in brief

  • If you are voluntarily insured, you terminate your GKV membership at the end of the next but one calendar month (§ 175 para. 4 SGB V).
  • The twelve-month binding period (Bindungsfrist) does not apply if membership ends by law.
  • Whether you can switch to PKV without a health check is decided by the tariff and the insurer, not by law.
  • Health insurance is compulsory in Germany. A seamless transition matters more than a fast switch.
  • Plan the switch around the date of your appointment as a civil servant, not after it. This keeps your aid and your cover connected.

When does your GKV membership end?

That depends on how you are insured now. If you are voluntarily in the statutory insurance, you must terminate it yourself. If you were compulsorily insured and become exempt because of your civil servant appointment, your compulsory membership ends by law. The table helps you classify your case:

Starting positionWhat you need to doDeadline
Voluntarily insured in the GKVTerminate with your health insurer, preferably in writing with proofEnd of the next but one calendar month
Membership ends by lawNo termination needed, but check the insurer’s confirmationOn the legal end date, no binding period
Additional contribution increasedSpecial termination until the end of the month from which the increase appliesBinding period does not apply

The special termination right is important because it applies regardless of your appointment. If your insurer raises its additional contribution, you may switch within the defined window without being bound for twelve months (§ 175 para. 4 sentence 6 SGB V).

How do you calculate the notice period?

The period is counted in calendar months. What matters is the month in which you give notice. The next but one calendar month is the end of your membership.

Assumption: you give notice on 15 October 2026. The next calendar month is November, and the next but one is December. Membership therefore ends on 31 December 2026. If you give notice on 5 January 2027, it ends on 31 March 2027, because February is the next month and March the next but one.

Your insurer must confirm the termination. Keep the confirmation and check whether the end date is correct. Switching to a new GKV insurer replaces the termination only within the GKV, not when you move to PKV.

Who comes straight from university?

Many trainees were previously in the student health insurance. That compulsory membership ends with the semester of your deregistration (§ 190 para. 9 SGB V). If a gap arises between the end of your studies and the start of the Referendariat, close it beforehand. Our guide on health insurance between your state exam and training explains how.

If you have voluntary statutory membership, also check which notice period your insurer states. A late notice extends your current membership to the next possible date, and the switch shifts accordingly.

What are the deadlines for PKV?

Different rules apply to PKV than to the GKV. What matters is the application, the tariff and the health check. Many insurers start cover only after accepting your application, and pre-existing conditions can lead to surcharges or exclusions. Check whether the insurer confirms the start of cover in writing.

Some insurers offer time-limited opening campaigns for civil servant beginners, in which applications are possible without a health check. Such campaigns are voluntary offers by the providers, not statutory deadlines. Ask specifically before you apply and get the conditions in writing.

Frequently asked questions

Can I switch to PKV before my appointment as a civil servant?

If you are voluntarily insured, you can usually terminate and take out private cover. Whether it is possible without a health check depends on the tariff. In the application, state your current status exactly and ask from when the trainee tariff applies. Civil servant health aid only starts with civil servant status.

What happens if there is a gap?

Health insurance is compulsory in Germany (§ 193 para. 3 VVG). A gap can lead to back payments and difficulties with treatment. Do not terminate before the new contract is confirmed.

Does the twelve-month binding period always apply?

No. It mainly concerns voluntary membership and changes of insurer. If membership ends by law, the binding period does not apply. Have this confirmed in writing by your insurer.

What if my appointment date moves?

Then your existing insurance continues until the new date is fixed. Terminate only once the appointment is confirmed in writing, and agree the timing with your insurer, so you are not briefly uninsured.

Must I inform my insurer about the appointment?

Yes. The insurer needs proof of your status, for example the appointment certificate. Report changes promptly so that no incorrect contributions arise, and keep a copy of the proof with your termination letter.

What does the statutory insurance versus PKV comparison look like?

The decision is not a matter of principle. Statutory insurance pays benefits under fixed rules, its contributions depend on income, and it accepts applicants without a health check. Civil servants usually use it only voluntarily, for example in the model of flat-rate health aid (pauschale Beihilfe). In that case they pay the contribution in full themselves.

Private insurance works with tariffs that can be adapted to health aid and supplementary cover. It requires a health check, premiums often rise with age, and pre-existing conditions can affect price or scope. Both systems have advantages and disadvantages, so compare over the whole period rather than just the first month.

So what should you do now?

  1. Clarify your status: check whether you are voluntarily or compulsorily insured and whether membership ends by law.
  2. Fix the date: calculate the termination date using the next but one calendar month and plan the switch around the appointment.
  3. Compare PKV offers: ask specifically about health checks, opening campaigns and the trainee tariff.
  4. Clarify the application first: obtain written confirmation of the start of cover before you terminate with your insurer.
  5. Keep the proof: store the termination, the insurer’s confirmation and the policy document together.
