The German pension scheme for lawyers (Versorgungswerk für Rechtsanwälte) is the occupational pension of the legal profession, and its rules differ between the federal states. According to the Bundestag’s research services (WD 6-3000-004/25, June 2025), Germany has 91 occupational pension schemes with more than one million members. This guide explains when you become a compulsory member, what determines the contribution and when employed lawyers can be exempt from statutory pension insurance.

Short answer: Lawyers become compulsory members of the scheme of their federal state once chamber membership exists under state law. Contributions are income-related and set in the scheme’s bylaws. Employed lawyers can apply for exemption under section 6 SGB VI, and the application should be filed within three months to take effect from the start. Last updated: October 2026.

The Essentials at a Glance

  • Responsibility: The relevant scheme is the one of your federal state, that is, the scheme of the chamber you belong to.
  • There are 91 occupational pension schemes across Germany (June 2025, Bundestag).
  • Contributions: The amount is set in your scheme’s bylaws. The law only requires income-related contributions that take the contribution assessment ceiling into account.
  • Exemption: Under section 6 SGB VI, employees and self-employed persons can be exempt if three conditions are met.
  • Deadline: If you apply within three months, the exemption takes effect from the start of the conditions. It covers only the specific job.

Who Must Join the Scheme?

The obligation follows from chamber and state law. The states have different statutes, so there is no uniform date that applies across Germany. Ask the lawyers’ chamber of your state when compulsory membership starts for you and which scheme is responsible.

Exemption From Statutory Pension Insurance for Employees

Employed lawyers are generally subject to statutory pension insurance. Under section 6(1) sentence 1 no. 1 SGB VI, employees and self-employed persons are exempt if they are members of a scheme and a chamber by law and meet three conditions:

  • The chamber obligation existed at the place of work before 1 January 1995.
  • Contributions are income-related under the bylaws and take the contribution assessment ceiling into account.
  • Contributions secure benefits for reduced earning capacity, old age and survivors, which are adjusted over time.

You file the application electronically through the scheme, which forwards it (section 6(2) SGB VI). The pension insurance carrier decides (section 6(3) SGB VI). The table shows how the cases differ.

CaseWhat appliesDeadline
Employed in a law firmExemption only for this employment, application through the schemeThree months for effect from the start of employment
Self-employed in your own practiceExemption possible under the same three conditionsThree months from when the conditions are met
Change of employerNew application needed, exemption covers the specific activityAgain three months from the new start

How High Are the Contributions?

The amount is set by your scheme’s bylaws, not by federal law. For comparison, the total contribution rate of statutory pension insurance is 18.6 percent in 2026 (contribution rate notice 2026). The contribution assessment ceiling of the pension insurance is 8,450 euros per month in 2026 (Deutsche Rentenversicherung, as of January 2026). The contribution to your scheme is a separate figure and cannot be derived from these numbers.

  1. Download the current bylaws of your scheme.
  2. Find the section on contributions and check which income the contribution is based on.
  3. Note the exemption deadline and compare it with the start date of your employment.

Which Benefits Are Covered?

The third condition requires contributions to secure benefits for reduced earning capacity, old age and survivors. The bylaws set the level of these benefits. If you want extra protection, compare what a private disability insurance (in German) pays, because the two systems follow different rules.

Frequently Asked Questions

Must I be exempt if I am an employed lawyer?

An exemption is an application and does not happen automatically. Without it, you pay contributions into statutory pension insurance and, depending on the bylaws, additional contributions into the scheme. Whether the exemption is worthwhile depends on salary, bylaws and the length of employment.

Does the exemption continue if I become self-employed?

An exemption covers only the specific employment or activity (section 6(5) SGB VI). Another compulsory activity is covered only if it is limited in time from the start. For your own practice, check whether a separate application is needed.

What if I miss the deadline?

The exemption then takes effect only from the date the application is received (section 6(4) sentence 1 SGB VI). There is no retroactive exemption beyond that point, so prepare the application as soon as your employment contract is signed.

Where can I get a binding answer?

The pension insurance carrier decides on the exemption. The scheme and the lawyers’ chamber of your state answer questions on membership and bylaws. For a personal assessment, you can contact Academycon (in German).

Next Steps

  1. Ask the lawyers’ chamber of your state whether and from when compulsory membership applies to you.
  2. Read the bylaws of the responsible scheme, especially contributions and benefits.
  3. When you start an employment, file the exemption application within three months through the scheme.
  4. Keep the deadline in mind whenever you change employer.
