Student Job 20-Hour Rule, Pension and Semester Breaks

Student job (Werkstudent): up to 20 hours per week you stay exempt from health, care and unemployment insurance. Pension and semester break rules explained.

The short answer on the 20-hour rule

As a student job holder (Werkstudent), you are exempt from health, long-term care and unemployment insurance as long as you work no more than 20 hours per week during the lecture period. The 20-hour rule applies to the working hours, not the pay. Pension insurance remains compulsory, and you share the contribution with your employer. During semester breaks, more generous rules apply, as long as you do not work over 20 hours for more than 26 weeks in a year.

How does the 20-hour rule work during lectures?

No more than 20 hours per week. What counts is the weekly working time actually performed, not the monthly pay. The amount of pay plays no role for the privilege, so the hour limit also applies if your hourly wage is above the minimum wage.

Several jobs are added together. If you work for two employers at 12 hours per week each, that makes 24 hours, which is above the limit. There is an exception for evening, night and weekend work. It can go beyond 20 hours if your studies remain the main focus.

What applies during semester breaks?

The lecture-free period is generally exempt from insurance. You can therefore work more during the holidays, as long as the privilege does not lapse. It lapses if you work more than 26 weeks in the calendar year over 20 hours. The following example shows the calculation.

  1. You work for twelve weeks during the semester break at 35 hours per week.
  2. Twelve weeks are below the limit of 26 weeks per year. The exemption from insurance remains.
  3. If, on the other hand, you work over 20 hours for 27 weeks in the year, the privilege lapses. The rules of normal compulsory insurance then apply to this employment.

Do I remain insured in pension insurance?

Yes. Pension insurance has no student job privilege. Therefore, the normal contribution obligation applies to you. The contribution is deducted from your pay and paid half by you and half by your employer. The pension points you collect while studying are explained in our article on pension insurance during studies.

  1. Gross monthly pay: €1,000.
  2. Total pension contribution 2026: 18.6%, which is €186 for €1,000.
  3. Your share is half: €93. Your employer pays the other €93.

Here is what to do now

  1. Note your weekly hours during the lecture period, separated by employer.
  2. Plan the semester breaks separately and count the weeks with more than 20 hours.
  3. Tell your employer your student status and ask for the type of insurance to be confirmed.
  4. Check the payslip for health and pension contributions.
  5. Before accepting more hours, ask your health insurer which insurance will then apply.

Frequently asked questions

May I work more than 20 hours at the weekend?

Yes, if it concerns evening, night or weekend work and your studies remain the main focus. The rule is an exception and not a free pass. Your studies must stay in the foreground, and the exception does not cover every form of work.

Does a minijob count towards my 20 hours?

Several jobs are added together for the hour limit. A minijob also has its own earnings limit. Our article Student job, minijob or midijob compared explains how the two forms differ.

What happens if I exceed 20 hours in one semester?

Then the exemption from health, long-term care and unemployment insurance lapses for this employment, and you are compulsorily insured there. Pension insurance continues unchanged. An early enquiry to your health insurer avoids surprises in the contribution statement.

Does the 20-hour rule also apply to a dual study programme?

No. In a dual study programme you are socially insured like an apprentice. The student job privilege does not apply there. The details are described in our article Dual study programme: family insurance, compulsory insurance and contribution (in German).
