Being pregnant during your Referendariat (the preparatory service for lawyers and teachers in Germany) raises several questions at once. How long may you not work, does your pay continue, and what happens to your exam date? Maternity protection, Beihilfe (state medical aid for civil servants) and the planning of your preparatory service interact here. This guide sorts the rules, names the deadlines and shows where you need to ask early.
Short answer: Under the German Maternity Protection Act (MuSchG), protection periods run six weeks before and eight weeks after delivery. After a premature or multiple birth, or where the child has a disability, the period after the birth extends to twelve weeks. For civil servants the maternity rules apply accordingly, and the states set the details. Last updated: October 2026.
The most important points in brief
- The protection periods are six weeks before and eight weeks after delivery (section 3 MuSchG).
- After a premature or multiple birth, the period after delivery extends to twelve weeks. Where the child has a disability, this applies only if you apply for the extension.
- According to an overview of maternity protection for civil servants, the employer continues full salary payments, and there is no maternity benefit from the health insurer in that case.
- Extending the preparatory service is governed by state law. In North Rhine-Westphalia, according to the FAQ, it is generally possible on application for up to six months.
- Ask the examination office early, before you fix exam dates.
Which protection periods apply?
The German Maternity Protection Act (Mutterschutzgesetz, MuSchG) sets the protection periods. The table shows the rules of section 3 MuSchG, as published on gesetze-im-internet.de.
| Period | Protection | Note |
|---|---|---|
| Before delivery | 6 weeks | Work is prohibited unless you expressly agree. You can withdraw this agreement at any time for the future. |
| After delivery | 8 weeks | Work is generally prohibited until this period ends. |
| Extended after delivery | 12 weeks | After a premature or multiple birth. Where the child has a medically confirmed disability, only if you apply for the extension. |
If delivery is early, the period after delivery is extended by the amount by which the period before delivery was shortened. The extension does not apply to a stillbirth.
A worked example makes the length tangible. Assumption: the birth proceeds without complications. Six weeks before and eight weeks after the birth then add up to 14 weeks, that is 98 days, during which the protection period applies. After a premature or multiple birth, it would be 6 plus 12 weeks, so 18 weeks or 126 days.
Does maternity protection also apply to civil servants in the Referendariat?
For civil servants, the Federal Civil Service Act (Beamtenstatusgesetz) refers to maternity protection in section 46. According to the overview Mutterschutz und Elternzeit für Beamte (in German), the maternity rules apply accordingly, and the states set the details by regulation. As an example, the overview cites North Rhine-Westphalia, where the Maternity Protection Act applies accordingly.
The overview does not deal with trainees separately. Your state office confirms whether you are treated like a civil servant. If you are in a public-law training relationship, also check with your health insurer which benefits apply.
How do pay and maternity benefit work?
According to the overview, civil servants do not receive maternity benefit from the health insurer. The employer continues full salary during the protection periods and during bans on work. The overview gives no separate statement for trainees. Clarify with your pay office how your trainee pay continues during the protection periods, before the period starts.
Medical costs around pregnancy and birth also run through Beihilfe and your private tariff. Which benefits count depends on your tariff. The basics of Beihilfe are explained in Beihilfe im Referendariat: Anspruch, Satz und Antrag (in German).
What happens to the preparatory service and the exams?
Absence can extend the preparatory service. According to the FAQ of the Bezirksregierung Köln on the Referendariat in North Rhine-Westphalia, the preparatory service can generally be extended on application by up to six months. The FAQ names reasons such as leave, illness or pregnancy (maternity protection), where the absence totals more than two months. The informal application needs proof of the absence. The FAQ is dated March 2014, so confirm the current rule with your examination office.
How maternity protection affects exam dates is governed by state law. Ask the examination office early, before you fix dates. For a comparable overview for students, see Mutterschutz im Studium: Prüfungen, Fristen und Nachteilsausgleich (in German).
Frequently asked questions
Do I get maternity benefit?
For civil servants, the overview explicitly names no maternity benefit from the health insurer, because the employer continues the salary. If you are in a training relationship, ask your health insurer which benefits apply to you.
May I work during the protection period?
Before delivery you may work only if you expressly agree. You can withdraw this agreement at any time for the future. After delivery, work is generally prohibited until the eight weeks have passed.
Does the protection period extend my training automatically?
No. You apply for the extension of the preparatory service separately. According to the NRW FAQ, this is done on application with proof, generally for up to six months. Other states may have different rules.
What applies if the child has a disability?
The period after delivery can then increase to twelve weeks, but only if you apply for the extension. The medical confirmation of the disability must come before the eight weeks have passed.
How do you plan with a buffer?
Lay out the protection period, a possible extension and the exam date side by side. This shows quickly where gaps appear. Things get tight when the protection period after delivery falls into the preparation for a fixed date. Plan with a buffer and clarify dates early.
Also record every agreement in writing. Date, contact person and the content of a phone call belong in a note, in case questions about periods or dates come up later. Parental leave is a separate topic and is covered in the guide on Referendariat and children (German).
What to do now
- Inform your employer of the pregnancy and ask when the maternity protection period is fixed.
- Clarify with the pay office how your trainee pay continues during the protection periods.
- If absence is likely, apply for an extension of the preparatory service and submit the proof.
- Clarify with the examination office how the absence affects your exam dates.
- Check Beihilfe and your private tariff for benefits around pregnancy and birth before costs arise.
