A service disability insurance (Dienstunfähigkeitsversicherung) for trainees is meant to step in if a lasting illness stops you from completing the preparatory service. Whether you need it depends above all on whether you are trained as an employee or as a probationary civil servant (Beamter auf Widerruf). This guide covers both cases and the points to check in any offer.

Short answer: Whether service disability insurance makes sense for a trainee depends on status. Employees are covered for short illness by continued pay for up to six weeks (section 3 EFZG) and afterwards by sick pay. For probationary civil servants, lasting service incapacity can lead to dismissal (section 23 BeamtStG). As of October 2026.

The essentials in brief

  • Your status decides first whether you need service disability insurance.
  • Employees receive pay from their employer for up to six weeks of illness (section 3(1) EFZG). Sick pay may follow (section 44 SGB V).
  • Probationary civil servants can be dismissed when they are permanently unfit for service (section 23(1) sentence 1 no. 3 BeamtStG).
  • The benefit definition in the contract decides when the insurer pays. Read it carefully before you sign.
  • Health information must be complete. Incomplete answers can put the contract at risk (section 19 VVG).

What protection do you have as an employee?

If you are employed in a Referendariat, you are compulsorily insured in the statutory health insurance (section 5(1) no. 1 SGB V). In case of illness your employer continues to pay your salary for up to six weeks (section 3(1) EFZG). The entitlement arises after four weeks of uninterrupted employment (section 3(3) EFZG). After that your fund may pay sick pay.

That does not mean that employees have no gap. Sick pay is time-limited. A pension for reduced earning capacity also requires contribution periods (section 43 SGB VI), which makes the position difficult in case of long-term illness.

What applies to probationary civil servants?

Under section 23(4) BeamtStG, probationary civil servants can be dismissed at any time. The law also provides that they should be given the opportunity to end the preparatory service and sit the examination. For lasting service incapacity, the dismissal rule of section 23(1) sentence 1 no. 3 BeamtStG applies, which refers to the requirements of section 26(2).

A service disability insurance is often thought of as a replacement for income in this situation. Whether it actually pays out depends on the contract and not only on the name of the product.

When can service disability insurance make sense?

It can make sense if a dismissal would hit your plans, you have few savings and fixed costs such as rent, loans or maintenance keep running. It is less central if you are well protected as an employee or have savings covering several months.

Reasons against a policy are: you cannot carry the premium over the long term, the health check leads to a surcharge or an exclusion, or the definition of service incapacity in the policy is so narrow that cover does not apply when you need it. Answering health questions correctly

Before you make the contract declaration, you must disclose all circumstances that the insurer has asked about in text form (section 19(1) VVG). If you breach this duty, the insurer may withdraw from the contract (section 19(2) VVG). That does not apply if the breach was neither intentional nor grossly negligent. In that case the insurer may terminate with one month’s notice (section 19(3) VVG).

Frequently asked questions

Is service disability insurance the same as occupational disability insurance?

No. Under section 172(2) VVG, a person is occupationally disabled if they cannot, wholly or partly, for a foreseeable long period, carry on their last occupation because of illness, bodily injury or age-related loss of strength. Service incapacity is a term of civil service law. How a policy defines either one is set out in its terms and decides when benefits are due.

Do I need to take out the policy before the Referendariat starts?

There is no obligation. Whether and when a policy makes sense depends on your health and your status. Health questions refer to the time of the contract declaration, so answer every question fully and keep a copy of the application.

Does the insurance pay if I am dismissed?

That depends on the policy. What matters is whether the benefit event links to service incapacity as defined in the policy and whether a dismissal resulting from it is covered. Ask for the definition in writing before you sign.

Is there a legal duty to hold service disability insurance during the Referendariat?

No. There is no statutory duty to hold this insurance. It is a voluntary decision, and its value depends on your status.

Which health insurance is an option after a dismissal?

After a dismissal, voluntary membership of the statutory insurance may be an option, if you were a compulsory member before and meet the pre-insurance periods (section 9(1) no. 1 SGB V). If you were privately insured before, this route is generally not available. More on this in Krankenversicherung nach dem Referendariat (in German).

So what should you do now?

  1. Clarify your status in the appointment letter or employment contract.
  2. List your monthly fixed costs and savings. Use an assumption for the loss, for example three months of net income.
  3. Check what benefits your employer, health insurance fund or employer as civil service authority already provides.
  4. Compare offers by benefit definition, exclusions and waiting periods, not only by premium.
  5. Answer all health questions fully and keep the application.
