Occupational disability during the traineeship is a topic many people underestimate, because civil service status seems to offer security. This guide explains what statutory pension insurance and civil service law provide in case of illness, how occupational disability insurance works for trainees and when it fits.

Short answer: Civil servants are generally not compulsorily insured in the statutory pension scheme and therefore usually have no disability pension there. In case of inability to serve, the benefits follow the Federal Civil Servants Pension Act (Beamtenversorgungsgesetz). Occupational disability insurance can close a gap but does not fit every case. The most important points

  • Civil servants are generally not compulsorily insured in the statutory pension insurance, so a disability pension from it is usually not an option.
  • In case of inability to serve, the benefits follow civil service pension law, not a private contract. Check the law and your employer for the scope.
  • Under section 172 of the Insurance Contract Act (VVG), occupational disability insurance pays from a degree of at least 50 percent occupational disability.
  • For trainees, acceptance depends on the occupation and your health, not on the length of the traineeship.
  • Health information must be complete, otherwise the claim is at risk.

What does statutory pension insurance pay for civil servants?

Anyone compulsorily insured in the statutory pension scheme can apply for a pension in case of partial or full reduced earning capacity. Under section 43 of Book VI of the Social Code (SGB VI), this requires, among other things, three years of compulsory contributions within the last five years. Civil servants are, under section 5 of Book VI SGB, generally exempt from compulsory pension insurance.

For you, this means that during the traineeship as a civil servant you usually do not build up compulsory contributions that would later justify a disability pension. If you paid compulsory contributions before becoming a civil servant, have your pension record checked, because earlier periods can remain.

How does civil service law protect you in case of inability to serve?

In case of inability to serve, the benefits follow the Federal Civil Servants Pension Act (Beamtenversorgungsgesetz). It regulates when a pension arises, how it is calculated and which conditions apply. The employer checks inability to serve, usually with medical assessment.

For trainees, what matters is whether an appointment on revocable terms exists or a training relationship. In a training relationship, these rules do not apply in the same way. Read the law and ask the training authority which legal form applies to you. Our guide on appointment on probation after university explains the basics of the legal form.

How does occupational disability insurance work for trainees?

Occupational disability insurance is a private contract. It pays according to the terms of the contract when the insured person can no longer exercise their occupation. The definition is set in section 172 of the Insurance Contract Act (VVG): an insured person is occupationally disabled if they can no longer exercise their most recently practised occupation to at least 50 percent.

For trainees, it is not straightforward which occupation counts as most recently practised. Insurers usually use the occupational profile you aim for and assess the case individually. Ask specifically before you conclude how your occupational profile is handled.

When does occupational disability insurance fit during the traineeship, and when not?

Occupational disability insurance is not compulsory and does not fit every situation. The comparison below shows typical trade-offs without making a recommendation.

SituationPoints for occupational disability insurancePoints against occupational disability insurance
Civil service statusYour status is still open or a training relationship applies, and you want to close the gap.The appointment is fixed and your pension entitlement is clear for you.
HealthYou are healthy and the application is accepted without exclusions.Pre-existing conditions lead to exclusions or surcharges that reduce the benefit.
BudgetThe premium is affordable for you and you plan long term. The premium strains your training budget and other protection comes first.
Life planYou plan a move to occupations outside civil service law.You stay a civil servant and the pension covers your needs.

Occupational disability insurance is one building block, not a substitute for overall planning. How it fits with health insurance and retirement provision depends on your situation.

What health information must you give?

When applying, you must answer health questions completely and truthfully. This follows from section 19 of the Insurance Contract Act (VVG). If you hide pre-existing conditions, the insurer may withdraw from the contract or refuse benefits. In case of doubt, a precise answer with medical findings is the better path.

Also check which occupations the contract covers and how it defines the loss of occupational capacity. Ask for the terms in writing and compare them with the information you gave.

Frequently asked questions

Do I need occupational disability insurance if I become a civil servant?

It depends on how secure your civil service status is and how you assess your need for a pension in an emergency. Whether a pension is enough in an emergency can be checked in civil service pension law. Occupational disability insurance can close part of the gap but does not have to.

Can I take out occupational disability insurance while still a trainee?

In many cases yes, but it depends on the insurer and on your occupational profile. Before applying, check whether the insurer accepts trainees in your training and under which conditions.

What changes with the appointment on probation?

With the transition to probation, the legal form and the pension change. Our guide on the appointment on probation after university (in German) explains how to plan the transition. Do not finalise your disability decision without considering this step.

What does occupational disability insurance cost?

The premium depends on occupational group, age, health and the scope of benefits. A figure without reference to your situation would be misleading, so this guide names no amount. Request several offers with identical conditions and compare benefits and price together.

What to do now

  1. Clarify in writing your legal form and the pension rules for your state and employer.
  2. Check your pension record if you paid compulsory contributions before becoming a civil servant.
  3. Compare occupational disability offers with identical conditions and note how your occupational profile is classified.
  4. Answer the health questions completely and have the conditions confirmed in writing.
