Doctorate with a Disability: Compensation and Your Rights

A disability does not rule out a doctorate. Learn which compensation for disadvantage you can request, how fixed-term posts are extended and what extra leave applies.

A doctorate with a disability is possible, and the law offers several starting points. A compensation for disadvantage (Nachteilsausgleich) adjusts the conditions, and a fixed-term post can run longer. This guide shows what you can request and which rules apply.

Short answer: You request a compensation for disadvantage from your university under its doctoral regulations. For a fixed-term post, a disability within the meaning of section 2 (1) SGB IX extends the permitted term by two years (section 2 WissZeitVG). Severely disabled employees get five working days of extra leave in a five-day week (section 208 SGB IX). Last updated: October 2026.

The key points at a glance

  • A compensation for disadvantage aims to offset a disadvantage. The academic requirements for your doctorate stay the same.
  • The rules are set in the doctoral regulations of your university and, where they exist, in state law.
  • For a fixed-term post, a disability or a serious chronic illness extends the maximum term by two years.
  • Severely disabled employees receive five working days of extra leave in a five-day week.
  • You generally need evidence for claims, for example a severe disability card or a medical certificate.

What is a compensation for disadvantage in a doctorate?

A compensation for disadvantage adjusts the conditions under which you complete your work, for example examinations, deadlines or the form of submission. Which adjustments are possible is set by the doctoral regulations of your university and, where they exist, by state law.

Submit the request to the responsible body of your faculty or university. Describe the need concretely: which limitation exists, which adjustment helps and which evidence you attach. For the basic terms, see the German guide on barrier-free studies (in German).

How is a fixed-term post extended?

Under section 2 (1) sentence 5 WissZeitVG the maximum term is extended by two years if there is a disability within the meaning of section 2 (1) SGB IX or a serious chronic illness. The table lists further reasons that affect the maximum term.

ReasonEffect on the maximum termProvision
Disability or serious chronic illness+2 yearssection 2 (1) sentence 5 WissZeitVG

Are you entitled to extra leave?

Severely disabled people are entitled under section 208 (1) SGB IX to five paid working days of extra leave per leave year, if the working week is spread over five days. Someone counts as severely disabled with a degree of disability of at least 50 (section 2 (2) SGB IX).

The wording refers only to severely disabled people. Ask your employer or the responsible office in advance whether people with equal status are also covered. The extra leave applies within an employment relationship. A pure scholarship is not employment, so it does not apply there.

Do you have to disclose your disability?

You decide whether to disclose it. Without disclosure, however, the university cannot consider a compensation for disadvantage, because it does not know the need. If you want to claim rights, you must be able to prove the conditions.

Frequently asked questions

Do I need a severe disability card?

For the extra leave under section 208 SGB IX you must be severely disabled, that is, have a degree of disability of at least 50. You generally prove this with a notice, for example the severe disability card.

Is the contract extended automatically?

No. The maximum term increases, but you agree the new term with the university. Raise it early with your supervisor so there is time to coordinate.

Where can I get advice?

Ask your university for the office responsible for students or staff with disabilities or chronic illnesses. There you learn which forms of compensation exist and which documents you need.

What applies if the disability arises during the doctorate?

A conversation with the doctoral advice service is worthwhile, to clarify entitlements and deadlines.

What to do now

  1. Read the doctoral regulations of your university and look for the rules on compensation for disadvantage.
  2. Submit the request and attach the evidence the university requires.
  3. Check your employment contract for extension rules and extra leave.
  4. Seek advice from the office for people with disabilities or the representative body for severely disabled staff.

Which evidence do you need?

Which evidence is required depends on the body that decides on the compensation and on your request. Medical certificates or proof of the degree of disability are possible. Ask in advance which form the university accepts, so the application does not fail on formal grounds.

Does the extension also apply to a scholarship?

The extension under the WissZeitVG concerns fixed-term employment contracts. A scholarship is not such an employment relationship, so this rule does not apply there. Whether compensation for disadvantage applies regardless of the funding is set by your doctoral regulations.

What if the university rejects the request?

A rejection is not the end. Ask for the reasons in writing and check whether the doctoral regulations provide for an objection procedure. The representative body for severely disabled staff or an advice service can help you organise the arguments and bundle the evidence.

How does extra leave fit with a fixed term?

Extra leave and the fixed term are separate issues. The leave is an entitlement within an existing employment relationship and applies per leave year. The extension concerns the maximum term of the fixed term. When planning the contract length, count the leave in, especially if submission deadlines and holidays overlap.

Submit requests as early as possible, before examinations or submission deadlines approach. An early application gives the university time for queries and you time to supply evidence.
