A fixed-term doctoral position (befristete Promotionsstelle) ends after a statutory maximum period set by the German Academic Fixed-Term Contract Act (WissZeitVG). This guide explains how long a fixed term may run, when it is extended and what unemployment benefit (Arbeitslosengeld I) can follow the end of the contract.
Short answer: Under the WissZeitVG a doctoral post may be fixed-term for up to 6 years before the doctorate and up to 6 years after it (9 years after the doctorate in medicine). Each child under 18 extends the maximum by 2 years. After the end you may be entitled to unemployment benefit if you meet the qualifying period. Last updated: October 2026.
The key points at a glance
- Before the doctorate a fixed term of up to six years is possible, and after it up to six years as well, nine years in medicine.
- Each child under 18 extends the maximum by two years. A disability or a serious chronic illness also extends it by two years.
- For posts financed mainly by third-party funds, the term can follow the approved project period.
- For unemployment benefit I, you generally need twelve months of social-insurance employment within the qualifying period.
- Register as job-seeking at the employment agency at least three months before the contract ends.
How long may a doctoral position be fixed-term?
The WissZeitVG sets upper limits that depend on the phase. Before the doctorate is completed the limits differ from those after it. The table lists the main rules from section 2 (1).
| Situation | Fixed term under the WissZeitVG |
|---|---|
| Before the doctorate | up to 6 years |
| After the doctorate | up to 6 years (medicine: 9 years) |
| Each child under 18 | +2 years (section 2 (1) sentence 4) |
| Disability or serious chronic illness | +2 years (section 2 (1) sentence 5) |

What applies to posts financed by third-party funds?
Posts financed mainly by third-party funds follow a separate rule in section 2 (2) WissZeitVG. A fixed term is permitted if the funding is approved for a specific task and period and you work mainly in line with the purpose of the funds.
The duration should match the approved project period. If a project ends after two years, the post generally ends too. Ask about the funding period when the contract is drafted.
Are you entitled to unemployment benefit after the contract ends?
That depends on your insurance record. You generally need at least twelve months of social-insurance employment within the qualifying period (section 142 (1) SGB III). A special rule applies to fixed-term employees: the qualifying period is six months if the employment was mainly fixed-term and your pay in the last twelve months did not exceed 1.5 times the relevant reference income (section 142 (2) SGB III).
The length of the benefit depends on the employment period and, above certain ages, on age. Source: section 147 SGB III (in German), gesetze-im-internet.de.
| Social-insurance employment in the qualifying period | Duration of unemployment benefit I |
|---|---|
| 12 months | 6 months |
| 24 months | 12 months |
| 30 months and age 50 | 15 months |
Example (assumption): you were employed subject to social insurance for 24 months and you are 31. Your entitlement is then 12 months. A pure scholarship does not meet this requirement, because there is no employment.
Do you have to register early?
Yes. If an employment relationship ends, you must register as job-seeking with the employment agency at least three months before the end (section 38 (1) SGB III). If fewer than three months remain, registration is due within three days of learning of the end. The duty applies even if you contest the end in court. Source: section 38 SGB III (in German).
What can come after a doctoral post?
Possible routes include a follow-on post at the university, such as a postdoc position, or a move into work outside academia. Which route fits depends on your field, funding and plans. For funding options, see the German guide on financing a doctorate.
Frequently asked questions
Does my post extend automatically if I have a child?
No. The statutory maximum increases by two years per child under 18. Whether and how your contract is extended is agreed with your employer. Raise this early with your supervisor.
What happens if my post ends before I finish?
The employment ends with the contract, even if your dissertation is not finished. Clarify early whether an extension under the law is possible, and plan the submission accordingly.
Does a doctoral scholarship entitle me to unemployment benefit?
No. A claim requires social-insurance employment. A scholarship is not such employment, so it does not create an entitlement.
Does the fixed-term rule also apply to third-party funded posts?
Yes, if the post is mainly financed by third-party funds. The purpose-based fixed term in section 2 (2) WissZeitVG then applies, and the duration follows the approved project.
What to do now
- Read your contract and note the end date, extension options and the type of post.
- Check whether children or a disability extend the maximum, and keep the evidence ready.
- Register as job-seeking at the employment agency at least three months before the end.
- Plan the submission of your dissertation and the next step early with your supervisor.
Checklist: what to check in your contract
- Legal basis: the contract states on which statutory ground the fixed term rests.
- End date: a specific date is clearer than an open wording.
- Funding: whether the post is paid from core budget or third-party funds decides which rule applies to the term.
- Grounds for extension: children, disability or illness can be documented. Keep the evidence ready.
- Tasks: how much time the contract reserves for the dissertation and which teaching or administrative duties come on top.
Worked example: from contract end to unemployment benefit
Assumption: your last fixed-term post ends on 31 March. You must register with the employment agency at least three months before, in this example by 31 December of the previous year. If you had 24 months of social-insurance employment in the qualifying period and you are under 50, the benefit period is 12 months (table above). The amount depends on further factors that this guide does not quantify.
What if the dissertation takes longer?
When the post ends before the thesis is finished, you have essentially two routes. Either the post is extended on a statutory ground, or you look for follow-on funding from a scholarship, third-party funds or your own resources. Discuss early with your supervisor and the doctoral office of your university which route is realistic.
In the employment-law sense a scholarship does not replace a post and does not count as employment. Funding by scholarship therefore follows its own rules, which the German guide on part-time doctorates also touches on when a part-time post is involved.
