Abstract Referral in Disability Insurance: Why It Matters

An abstract referral can limit disability insurance benefits even without a specific job. What it means, why students are affected and how to check your tariff.

The abstract referral clause (abstrakte Verweisung) sits in the small print of many disability insurance contracts and is rarely explained when you sign. For students it matters especially, because the occupation they will practise has not started yet. This guide explains the term, shows how it differs from a concrete referral and tells you how to check your terms.

Short answer: With an abstract referral the insurer may refer you to another activity without a specific job having to exist. With a concrete referral, you must actually be working in that other activity. Whether your tariff contains such a clause is stated in the terms. Last updated: October 2026.

The Most Important Points in Brief

  • An abstract referral allows the insurer to measure your ability to work against another activity, even if you have never practised it.
  • A concrete referral is usually more favourable for you, because it applies only once you actually work in the other activity.
  • For students the occupation in the contract is often still open, so the referral plays a bigger role than for people already at work.
  • Courts check whether another activity corresponds to your training, your income and your social standing.
  • Before you sign, ask specifically whether your tariff contains an abstract referral or does without one.

What Does Abstract Referral Mean?

Disability insurance pays out if you can no longer practise your last occupation. The legal basis is § 172 of the German Insurance Contract Act (VVG). Many tariffs extend this protection or limit it through a referral clause. The clause allows the insurer to check whether you could carry out another activity that suits you.

With an abstract referral the insurer checks only in theory whether such an activity would be conceivable for you. A specific vacancy does not have to exist. With a concrete referral, by contrast, what counts is whether you actually carry out a suitable other activity. Only then can the insurer refuse the benefit.

Why Is This Especially Important for Students?

A degree is not an occupation in the classic sense. If you take out disability insurance before you enter working life, the question is open as to what the insurer should measure your ability to work against. Tariffs regulate this differently. Under an abstract referral, an insurer can examine whether, with your training, you could carry out another activity. In practice the course of study is often used as the reference point.

Here the wording decides. Whether an insurer treats another subject or career path as reasonable depends on your training, your future income and your social standing. An activity that lies well below your training is not accepted without further ado. Courts weigh these criteria case by case.

Worked Example from Student Life

Assumption: you study to become a teacher and have a disability insurance contract with an abstract referral clause. After a serious illness you can no longer work in schools permanently. The insurer now examines whether an administrative or office job would be reasonable for you, although you have never practised it and no specific post exists.

Whether the insurer succeeds depends on the wording of the clause and on whether the other activity matches your training, your income and your social standing. An administrative job with markedly lower qualification and pay would hardly be considered reasonable on that basis. A comparable activity at a similar level would be assessed differently. That is why you should read the tariff before you sign and clarify the question in writing.

The example also shows why the occupation stated in the application matters. The more precisely the occupation is described, the clearer it is later which activities count as equivalent. The German guide on the disability pension as a student helps you set the amount, but the referral clause decides whether that benefit is actually paid in an emergency.

How to Recognise the Referral in Your Contract

The clause rarely appears under a heading of its own. Look for terms such as referral, other activity, previous standing in life or reorganisation. Use the policy terms, not just the offer or the product summary.

Frequently Asked Questions

Can I exclude an abstract referral when I take out the contract?

You can ask specifically for tariffs that do without an abstract referral. Many insurers have removed it from their tariffs in recent years, while others have not. Whether your tariff contains it is stated in the contract, not in the comparison.

Does the referral also apply to pupils?

The question is similar. Even for pupils, an insurer can examine whether another school type or another training path would be reasonable, if the contract provides for it. Pupils should therefore also check the clause.

What happens if I work in a different job after my studies?

The contract is not adjusted automatically. What matters is which occupation the protection refers to and whether that occupation is already defined in the contract. If you change careers, have the consequences for your protection checked.

What should I do if the insurer refers me to another activity?

Ask for the reasons in writing. Ask which activity you are referred to, which criteria apply and which evidence the insurer relies on. Do not simply accept a refusal without a comprehensible justification.

What to Do Now

  1. Read the policy terms and look for a referral clause before you sign.
  2. Compare whether the tariff uses a concrete or an abstract referral and note the benchmark it uses.
  3. Ask the insurer specifically how the clause applies to your course of study, and request a written answer.
  4. Keep the documents safe, because they matter in a claim. For a personal assessment, see how we work (in German).
