Pension insurance (Rentenversicherungspflicht) does not apply to all self-employed people. If you work on your own account, the obligation only applies when your occupation or your client structure is named in § 2 of Book VI of the German Social Code (SGB VI). That is where the check starts.

Short answer: Not every self-employed activity is subject to statutory pension insurance. § 2 SGB VI (in German) names specific groups, including craftspeople registered in the Handwerksrolle (the register of skilled trades), teachers and childcare workers without employees subject to insurance, and self-employed people who work mainly for one client. Your concrete activity decides. Last updated: November 2026.

The most important points

  • Self-employment alone does not create a general obligation to pay into statutory pension insurance.
  • The obligation applies to the groups named in § 2 SGB VI.
  • A separate rule covers self-employed people who work for only one client and employ no insured employees.
  • Certain members of professional pension schemes (berufsständische Versorgungswerke) may be exempt under § 6 SGB VI.
  • People who newly become self-employed may be exempt for three years under certain conditions.

Which self-employed people are subject to pension insurance?

The list in § 2 SGB VI is organised by occupation and type of work. The table below shows the groups that matter most for students, career starters and freelancers. It does not replace an individual check.

Group under § 2 SGB VITypical activityImportant note
Craftspeople in the HandwerksrolleTrade businesses registered in the HandwerksrolleExceptions for certain craft businesses under the Crafts Code
Teachers and childcare workersSelf-employed without regularly insured employeesThe number of employees is decisive
MidwivesFreelance work in childbirth careApplies according to the statutory wording
Artists and publicistsActivity under the Artists Social Security Act (KSVG)Separate protection through the Künstlersozialkasse
Self-employed with one clientRegularly no insured employees, mainly working for one clientDuration and structure of the work are decisive

What applies to self-employed people with only one client?

The group under § 2 sentence 1 number 9 SGB VI covers people who regularly employ no insured employee and who work for a long term mainly for one client. For partners in a company, the clients of the company count as well. If you have several clients, you usually do not fall into this group. A long-term fixed commitment can still be enough, so the question must be checked case by case.

This point matters especially for students who take on freelance work. How to start freelancing during your studies is explained in Freelancing as a Student (in German). For pension insurance during studies, see Pension insurance during studies (in German).

When is there an exemption?

Under § 6 para. 1 SGB VI, employees and self-employed people are exempt if, because of a legal duty, they are members of a professional pension scheme and a chamber, provided three statutory conditions are met. Under § 6 para. 1a SGB VI, self-employed people in the group of § 2 sentence 1 number 9 are exempt for three years after starting their first self-employment. From age 58 a special rule applies if the obligation arises for the first time after earlier self-employment. The version of the law in force is decisive.

Frequently asked questions

Do freelancers have to pay in automatically?

No, not automatically. What matters is whether you fall into one of the groups in § 2 SGB VI. Many freelancers are not subject to pension insurance because they have several clients or employ insured staff. The classification should be clarified with the Deutsche Rentenversicherung (German Pension Insurance).

What applies if I am a member of a professional pension scheme?

An exemption under § 6 para. 1 SGB VI may then be possible. The conditions are set out in the law. The Deutsche Rentenversicherung clarifies individual cases, because membership and the chamber obligation are the decisive points.

What if I overlooked an obligation?

Then it is worth clarifying your status with the Deutsche Rentenversicherung as early as possible, before claims or contributions become disputed. The earlier the status is checked, the easier it is to plan retirement provision.

How high are the contributions?

The amount depends on the contribution rate of the relevant year. According to the contribution rate notice for 2026 (in German), the general rate was 18.6 percent. No binding figure for 2027 is available yet.

What to do next

  1. Check whether your activity is named in § 2 SGB VI.
  2. Clarify how many clients you have and whether you employ anyone subject to insurance.
  3. Check possible grounds for exemption under § 6 SGB VI, for example membership of a professional pension scheme.
  4. Have your status clarified with the Deutsche Rentenversicherung before contributions become outstanding.
  5. Plan your retirement provision as a whole, see the overview of retirement provision 2027 (in German).

An example of the one-client question

Assumption: you work as a graphic designer without employees. For the past year you have worked mainly for one publishing house that commissions you regularly, and you take on occasional work for other clients. Whether this counts as working “mainly for one client” in the sense of § 2 sentence 1 number 9 SGB VI depends on the overall picture: the duration, the scope and whether the cooperation is a fixed, long-term arrangement.

The example shows that a single number does not decide. Anyone at the boundary should collect contracts, invoices and order overviews and discuss them with the Deutsche Rentenversicherung.

Which documents help with the classification

  • Framework contracts and order confirmations with term and scope.
  • Invoices covering several months, showing who the clients are.
  • Evidence of any people you employ.
  • A short overview of your activity, business registration and any entries such as the Handwerksrolle.

Obligation or exemption: what it means for your provision

Where an obligation applies, the statutory pension forms the basis, and private provision supplements it. With an exemption, for example through a professional pension scheme, that scheme provides the old-age pension. In both cases it pays to look at the whole picture, for example via the overview of retirement provision 2027 (in German).

Is the three-year exemption automatic?

The provision links the three-year exemption to the start of the first self-employed activity. Whether a procedure is needed and how it runs is clarified by the Deutsche Rentenversicherung in each case. Keeping the deadline in view avoids later surprises.

Common misunderstandings

  • Being self-employed does not automatically mean you are subject to pension insurance.
  • A business registration alone does not decide the obligation. The group under § 2 SGB VI is decisive.
  • Several clients usually take you out of the one-client group, but the overall situation remains decisive.

If you keep these points in mind, you ask the right questions. The answers come from checking the individual case, not from a general rule.
