Teachers who plan a career in a German state school often ask whether they need a disability insurance for teachers. The answer depends on a basic difference: for civil servants (Beamte), the state already provides a pension if they can no longer work, and that protection works differently from occupational disability insurance in the private sector. This guide explains what German civil service law provides and where a private policy can fill a gap.
Short answer: If a civil servant with tenure becomes permanently unfit for service (Dienstunfähigkeit), the employer first checks whether another post is possible. If not, the person is retired. Under federal law (§ 14 BeamtVG), the pension is at least 35 percent of the pensionable salary, provided there are at least five years of pensionable service. Whether extra private cover makes sense depends on service years, health and life plans. Last updated: October 2026.
The most important points
- Civil servants with tenure are retired when they are permanently unfit for service, after the employer has checked whether they can be used elsewhere (§ 26 BeamtStG).
- Under federal law the pension rises by 1.79375 percent per year of service and is capped at 71.75 percent (§ 14 para. 1 BeamtVG).
- The minimum pension is 35 percent of the pensionable salary once there are at least five years of pensionable service (§ 14 para. 4 BeamtVG).
- If the incapacity is not caused by an accident at work, the pension is reduced by 3.6 percent per year of early retirement, up to 10.8 percent in total (§ 14 para. 3 BeamtVG).
- A private occupational or service disability policy is a separate contract. Whether it closes a gap only becomes clear when you compare it with the civil service pension and the policy terms.
- Health questions in an application must be answered completely and truthfully (§ 19 VVG).
What happens to a civil servant who becomes unfit for service?
“Dienstunfähigkeit” is a legal term in German civil service law and does not mean the same as “cannot work” in everyday language. Under § 26 para. 1 BeamtStG, civil servants with tenure are retired if they are permanently unable to fulfil their duties. The cause can be physical or mental. A person can also be treated as unfit if, within six months, they are absent from duty for illness for more than three months and no recovery can be expected. The state law sets the exact period.
Before retirement, the employer checks whether the person can be assigned elsewhere. Under § 26 para. 2 BeamtStG, a post with at least the same basic salary within the same employer may be assigned without consent if the health requirements are likely to be met. Under § 26 para. 3 BeamtStG, a lower-graded activity may also be assigned to avoid retirement. Which post is suitable is decided by the employer case by case.
How high is the pension after incapacity?
The pension depends on the pensionable years of service and the pensionable salary. Under § 14 para. 1 BeamtVG, each year of service earns 1.79375 percent, up to a maximum of 71.75 percent. If someone becomes unfit early, they have few years of service. In that case the minimum pension under § 14 para. 4 BeamtVG applies: 35 percent of the pensionable salary, provided that service lasts at least five years.
| Pensionable years of service | Calculated rate (1.79375 % per year) | Pension after minimum rule |
|---|---|---|
| 5 years | 8.97 % | 35 % |
| 10 years | 17.94 % | 35 % |
| 15 years | 26.91 % | 35 % |
| 20 years | 35.88 % | 35.88 % |
Worked example. Assumption: federal law, no further supplements, percentages of the pensionable salary. The German states have their own pension laws, so these figures cannot be transferred to your state without checking.
A reduction also applies to early retirement. If the incapacity is not caused by an accident at work, § 14 para. 3 BeamtVG reduces the pension by 3.6 percent for each year of early retirement, capped at 10.8 percent in this case. The pension office decides how this applies to your situation.
When can a private policy make sense?
A private policy is not the right answer for everyone. In favour of one, a short service period and the reduction can leave a gap compared with the income you are used to. Against it, premiums run for many years and must fit a trainee salary and an early career. The civil service pension is also already a legal entitlement.
Reasons in favour:
- If incapacity comes early, service years are short and the minimum pension becomes the decisive figure.
- The reduction for early retirement without an accident at work can noticeably affect the standard of living.
- Health questions are asked when the policy is taken out. Pre-existing conditions can make acceptance harder later.
Reasons against:
- The civil service pension is a claim against the employer, not an insurance product. The two cannot simply be compared.
- Premiums run for years and must match the salary during the trainee phase and at the start of work.
- The benefits depend on the policy terms, for example on referral clauses that § 172 para. 3 VVG allows.
What to check in an occupational or service disability policy
Occupational disability in insurance law is governed by § 172 VVG. Under paragraph 2, a person is occupationally disabled if they can no longer, wholly or partly and probably for a long time, exercise their last occupation because of illness, bodily injury or age-related loss of strength. The way the policy describes your occupation is therefore decisive. Teachers should check whether teaching is covered or whether the wider profession is.
Under § 172 para. 3 VVG, the insurer may contractually require that the insured person does not perform, or cannot perform, another activity that matches their training and abilities. Such a referral clause is often the most important point in the terms. The duty to disclose under § 19 VVG applies as well: questions about health and previous conditions must be answered completely and truthfully. Concealed information can jeopardise cover.
Read the term, the premium development and the health check rules in full before you sign. Compare the conditions, not only the premium, because a low premium says little about how a claim would be handled.
Frequently asked questions
Do I automatically get a pension if I am a civil servant with tenure and become unfit for service?
If you hold tenure and the conditions for retirement are met, you have a claim to a pension. Its amount depends on service years, salary and state law. The pension office of your state calculates the entitlement in your individual case.
Does the 35 percent minimum apply to teachers in the German states?
The 35 percent figure comes from the federal Beamtenversorgungsgesetz. The states have their own pension laws, which can differ in detail. Check the figure in your state law before you base a decision on it.
Does the pension question apply during the trainee period?
During the trainee period (Vorbereitungsdienst) you are, depending on the state, a civil servant on probation or in a training relationship under public law. The rules for civil servants with tenure under § 26 BeamtStG therefore do not apply to you in the same way. Ask the body that runs your trainee period about your status.
Do I have to disclose pre-existing conditions for a disability policy?
Yes. Under § 19 para. 1 VVG you must disclose material risk circumstances about which the insurer has asked in text form. If you conceal pre-existing conditions, you risk restrictions or loss of cover when you claim. If you are unsure, ask before you submit the application.
Is a policy still worth considering if I will become a civil servant anyway?
That cannot be answered in general terms. What matters is your service time before a possible incapacity, the minimum pension in your state, the reduction rules and your personal needs. Work out the calculation for your own case instead of taking figures from an example.
How to proceed now
- Ask the competent authority in your state for the rules on pensions after incapacity, especially the minimum pension and the reduction.
- Set your years of service, salary and needs side by side. Use clearly stated assumptions rather than unfounded estimates.
- Compare policy terms such as occupational description, referral clause, term and health check before you compare premiums.
