If you want to extend a doctoral post in Germany, you quickly run into the maximum duration set by the Wissenschaftszeitvertragsgesetz (WissZeitVG, the Act on Fixed-Term Contracts in Academia). Many people are affected: according to Destatis, around 216,200 people were doing a doctorate in 2025 (press release of 26 August 2026). Whether a post can be extended depends on the law, the contract and the funding.
Short answer: A doctoral post in Germany can only be extended within the maximum duration set by the WissZeitVG. The fixed term for qualification is limited to six years (section 2 (1)). For each child under 18, the duration is extended by two years (section 2 (1) sentence 4). An extension due to care or nursing requires the consent of the employee (section 2 (5)). Status: October 2026.
Key points at a glance
- The fixed term for the qualification phase is limited to six years under the WissZeitVG.
- Caring for a child under 18 extends the maximum duration by two years per child.
- A disability or a serious chronic illness also extends the maximum duration by two years.
- Extensions due to care or nursing require the consent of the employee.
- The law does not grant a general right to continued employment. Whether a university extends a post depends on the funding.
Which maximum duration applies to your doctoral post?
The maximum duration results from several rules that build on each other. The table shows the main cases and the provision that applies to each.
| Case | Effect on the maximum duration | Provision |
|---|---|---|
| Qualification in general | Fixed term of up to six years | Section 2 (1) sentence 1 WissZeitVG |
| Human medicine | Different, longer maximum duration after the doctorate | Section 2 (1) sentence 2 WissZeitVG |
| Caring for a child under 18 | Two years per child | Section 2 (1) sentence 4 WissZeitVG |
| Disability or serious chronic illness | Two years | Section 2 (1) sentence 5 WissZeitVG |
| Leave or part-time work for care or nursing | Extension with consent, generally no more than two years per case | Section 2 (5) WissZeitVG |
The difference between the maximum duration and the contract term matters. The maximum duration is an upper limit. A contract can run for a shorter period, and it must stay within this limit. The university sets the contract term, while the law sets the maximum duration. If the contract initially runs for a shorter time, the maximum duration still forms the frame for later extensions.
How do you calculate the deadline?
A worked example makes the logic clear. Assumption: you start a doctoral post on 1 October 2026 for an initial term of three years. A child under 18 joins the household. The maximum limit then increases by two years, so the total duration can rise from six to eight years. Whether that full period is actually used depends on the contract. The example also shows that two extension grounds can apply at the same time without excluding each other.
- List all earlier fixed-term posts at universities and research institutions, with start and end dates.
- Add the periods that the law requires you to count. Whether a period counts depends on the provision in each individual case.
- Subtract that time from the maximum duration to find the remaining frame.
- Record grounds such as children, disability or care periods with the supporting documents.
- Ask the personnel office for a written calculation before you plan an extension.
The calculation is not straightforward, because earlier employment and grounds for extension can interact. A written statement from the personnel office is therefore more reliable than your own calculation.
Extension with consent: how it works
Under section 2 (5) WissZeitVG, the fixed term is only extended by leave or part-time work for the care of children or relatives in need of care with the consent of the employee. This covers children under 18 and relatives in need of nursing care. Part-time work must amount to at least one fifth of the regular working time for the rule to apply.
This construction matters for you as an employee, because you have to agree to the extension. Ask for the consequences for pay, leave and social insurance in writing before you sign. An extension on paper helps little if the post ends afterwards.
Typical mistakes when extending
In practice, extensions rarely fail because of the law itself. They fail because of details that could have been clarified earlier. The following points come up again and again and can be avoided with some preparation.
- The deadline is calculated from memory, although earlier posts are not fully recorded.
- A child or care situation is reported to the personnel office late, so contractual deadlines have already passed.
- A part-time arrangement is agreed without checking the one-fifth minimum.
- Consent to an extension is given verbally and cannot be proven later.
Document every period with dates, type of post and proof. A simple folder with contracts, payslips and certificates saves much clarification work later, especially when several contracts follow each other.
Frequently asked questions
Do I have a legal right to an extension of my post?
The WissZeitVG limits fixed terms, but it does not guarantee continued employment. An extension of the maximum duration under section 2 (1) and (5) depends on the conditions mentioned. Whether the post is actually extended is governed by the contract and the funding.
Does the extension also apply to part-time work?
For part-time work for care or nursing, section 2 (5) only applies if the working time is at least one fifth of the regular working time. Below that threshold, the rule does not apply.
Do I have to prove the child or the disability?
As a rule, the university requires proof, for example a birth certificate or a medical certificate. Ask the personnel office which documents count and how they must be submitted.
Does the WissZeitVG also apply to third-party funded posts?
Third-party funding follows special rules described in section 2 (2) WissZeitVG. Whether your post falls under them is shown by your employment contract and the notice of funding.
Who can advise me if I am unsure?
The first point of contact is the personnel office of the university that signed your contract. The staff council (Personalrat) represents the interests of employees and can help too. For questions on contract design or disputes, a trade union or a legal adviser is the next step. Note who said what in every conversation.
What changes for health insurance when the post ends?
When employment ends, the insurance that depends on it also ends, even if the doctorate continues. Plan early how you will stay insured. An overview of the cases is available in Health Insurance for PhD Students in Germany.
What to do now
- Calculate the maximum duration in writing with the personnel office before you discuss an extension.
- Collect all proof for children, disability or care as soon as the reason arises.
- Clarify the effects of part-time work on pay, leave and insurance before you agree.
- Plan the end of the contract early, so that follow-on funding, a scholarship or insurance is arranged in time.
