A Promotionsvertrag (doctoral employment contract) is usually a fixed-term employment contract that employs you during your doctorate at a university or research institution in Germany. If you check it before signing, you avoid the most common pitfalls around duration, workload and pay.

Short answer: A Promotionsvertrag is usually a fixed-term employment contract. Check the reason for the fixed term, the duration, the workload, pay, leave and notice periods. A fixed term is only valid if it is agreed in writing (section 14 (4) TzBfG). For qualification posts at universities, the WissZeitVG limits the fixed term to six years (section 2 (1)). Status: October 2026.

Key points at a glance

  • A fixed term must be agreed in writing. A verbal promise is not enough.
  • The contract should name the reason for the fixed term. For qualification posts this is usually the WissZeitVG.
  • Check the share of a full-time post and the working hours, because they determine pay and the timetable of your doctorate.
  • Check leave, probation period and notice periods. Fixed-term contracts can only be terminated ordinarily under certain conditions.
  • The contract alone does not decide your insurance. It follows from your employment and your status.

Which clauses in a Promotionsvertrag matter most?

Not every clause carries the same weight. The table shows what to check and which legal framework applies.

ClauseWhat you checkLegal framework
Fixed term and durationReason for the fixed term, start and end date, reference to the qualification goalSection 14 (4) TzBfG, section 2 WissZeitVG
WorkloadShare of a full-time post in percent, weekly working hours, rules on side jobsContract and university rules
Pay and pay gradePay grade, step, special payments and allowancesCollective agreement of the German state, often TV-L at state universities
LeaveNumber of leave days, partial leave if you start or leave during a yearSections 4 and 5 BUrlG
TerminationProbation period, notice periods, rules on ordinary terminationSection 622 BGB, section 15 (3) TzBfG

The share of a post directly affects how long your doctorate can run. Ask in a meeting how working hours are linked to supervision and which expectations on progress apply. This is not a formality. It decides whether the timetable is realistic.

When is the fixed term valid?

A fixed term requires written form. This means the contract and the signatures of both parties must exist, ideally before work starts. Under the WissZeitVG (in German), a fixed term for qualification is generally limited to six years. Third-party funded posts follow their own rules, which are set out in the same section.

If there is no objective reason, the fixed term can be invalid. In that case the contract may be treated as open-ended (section 16 TzBfG, in German). Whether this applies to you is an individual question. Clarify it with the personnel office or the staff council before you assert any rights.

How to check the contract step by step

  1. Read the fixed-term section first. Check the reason, the end date and the written form.
  2. Calculate workload and pay. Does the share of the post match the working hours you can realistically deliver?
  3. Compare the pay grade with the collective agreement that the contract refers to.
  4. Check leave, probation period and notice periods.
  5. Ask about anything missing, such as the supervision agreement, side jobs or parental leave.

What does the probation period mean in a Promotionsvertrag?

A probation period is not mandatory. If one is agreed, it may last no longer than six months. During the probation period, the notice period is two weeks (section 622 (3) BGB, in German). Afterwards, the periods set in the contract or the collective agreement apply. Make sure the probation period is named explicitly in the contract, because otherwise it may not count as agreed.

Leave, part-time work and parental leave in the contract

The statutory leave entitlement arises after a waiting period of six months (section 4 BUrlG, in German). If employment starts or ends during a year, you are entitled to partial leave (section 5 BUrlG, in German). Many contracts grant more leave under the collective agreement, so check what your contract says.

Parental leave and childcare affect the maximum duration of a fixed term. The WissZeitVG contains its own extension rules for this. If you have family plans, discuss the effects with the personnel office early, so the contract does not surprise you later.

Frequently asked questions

Does the Promotionsvertrag have to be in writing?

For the fixed term, yes. A verbal promise is not enough, because written form is a condition for the fixed term to be valid. Ask for the complete contract including all annexes.

May I take on a side job?

The contract or the university decides this. Side jobs can reduce your working hours and change the timetable of your doctorate. Ask beforehand and get the answer confirmed in writing.

What happens if the reason for the fixed term is missing?

Then the fixed term may be invalid, and the contract may count as open-ended. Discuss such a question with the staff council of the university or a trade union before you assert any rights.

Can I check the contract without a lawyer?

Yes, many points can be clarified with the legal texts and the collective agreement itself. For uncertain cases, such as a termination or an extension, legal advice is sensible.

What happens when the contract ends?

When the fixed term ends, the employment usually ends as well, and with it the compulsory insurance that depends on it. Clarify early whether a follow-on post, a scholarship or another status comes next. Ask for a reference and a certificate of your employment period before you leave. Keep all payslips and the contract with its amendments, because you need them for insurance, tax and later applications.

How does health insurance relate to the contract?

The contract describes the employment from which social insurance follows. Whether you are compulsorily insured depends on your activity, not only on the wording of the contract. An overview of the cases is available in Health Insurance for PhD Students in Germany.

What to do now

  1. Request the complete contract including annexes before you sign.
  2. Note all open questions and clarify them in writing with the personnel office.
  3. Check the supervision agreement and the goals that apply to your doctorate.
  4. Keep a copy of all documents before you start working.
