Students enrolled at a German university are usually compulsorily insured through the statutory student health insurance scheme (KVdS). An exemption from this obligation is possible, but only under strict conditions and within fixed deadlines. This guide explains what § 8 SGB V (Sozialgesetzbuch V, the Social Code Book V) provides, how the application works and when an exemption does not suit you.
Kurz beantwortet: Students can apply for an exemption from compulsory insurance under § 8 para. 1 no. 5 SGB V. The application must be made to your fund within three months of the start of the obligation. The exemption cannot be revoked, and it only takes effect once you prove that you have other entitlement to cover in case of illness. Last updated: October 2026.
The most important points at a glance
- The exemption is an application. It does not take effect automatically.
- The deadline is three months from the start of compulsory insurance (§ 8 para. 2 SGB V).
- Without proof of other entitlement to cover in case of illness, the exemption does not take effect.
- The exemption cannot be revoked, so the decision is final.
- When the exemption takes effect depends on whether you have already used benefits from your fund.
What are the legal conditions?
Under § 8 para. 1 no. 5 SGB V, an exemption can be granted to a person who becomes compulsorily insured through enrolment as a student or through a practical activity. This refers to students under § 5 para. 1 no. 9 and trainees under no. 10. The law sets no further conditions for this case. Under § 8 para. 1 sentence 2 SGB V, you also do not need to be becoming compulsorily insured for the first time.
The joint basic guidance of the GKV-Spitzenverband on the KVdS (version of 20 March 2020, in German) adds that the exemption relates to the specific basis for insurance. If compulsory insurance arises again later, for example through a further degree, a new right to an exemption may arise (section 3.3). Check the current version with the GKV-Spitzenverband.
How does the application work?
- Check whether your enrolment places you under compulsory insurance under § 5 para. 1 no. 9 SGB V, and note the start date.
- Clarify your other cover in case of illness and get written proof before you apply.
- Submit the application to your fund within three months of the start of compulsory insurance.
- Keep the application, the proof and the fund’s confirmation for the long term.
When does an exemption take effect?
The exemption takes effect from the start of compulsory insurance if you have not yet used benefits from your fund by then. If you have already used benefits, it takes effect from the calendar month after the application (§ 8 para. 2 sentence 2 SGB V). This difference can mean that contributions are paid twice for a period, so apply as early as possible.
A worked example of the deadline
Assumption: your compulsory insurance starts with the start of the semester on 1 October 2026. The three-month deadline then runs to the end of 2026. Do not submit on the last day, though. An earlier application leaves time for questions about proof and shows whether any documents are missing. Keep your enrolment certificate, which documents the start of the obligation.
When does an exemption suit you, and when not?
An exemption is a permanent decision that cannot be revoked. The table compares the main points you should clarify beforehand.
| Point | An exemption can suit you if | An exemption is less suitable if |
|---|---|---|
| Cover in case of illness | Other cover exists and can be proven | Proof is missing or uncertain |
| Decision | It is deliberate and planned for the long term | It is made at short notice without comparison |
| Deadline | The application is made within three months | The deadline has already passed |
| Return | You have checked the consequences of an irrevocable decision | You want to reverse the decision later |
Whether an exemption is worthwhile for you cannot be answered in general terms. Contributions, benefits, health and life plans all shape the balance. The comparison should therefore cover several years, not just the first month. The statutory side is explained in the German guide Krankenversicherung als Student (in German).
Frequently asked questions
Can I simply apply for an exemption?
No. The exemption depends on an application, a deadline and proof of other cover in case of illness. Without that proof it does not take effect, even if the application has been submitted.
What proof do I need?
The proof must show that you have other entitlement to cover in case of illness. Your fund will tell you which form it requires. Without this proof, the exemption does not take effect under § 8 para. 2 sentence 4 SGB V. Submit it with the application rather than sending it later.
What if I have already used benefits?
In that case, the exemption takes effect only from the calendar month after the application (§ 8 para. 2 sentence 2 SGB V). Compulsory insurance continues for the period before, and contributions keep running.
Can I reverse the exemption later?
No. Under § 8 para. 2 sentence 3 SGB V, the exemption cannot be revoked. You should therefore make the decision only once you have completed your comparison.
Does the exemption also apply to a later degree?
The exemption relates to the specific basis for insurance. If compulsory insurance arises again later, a new right to an exemption may arise. Whether this applies to you depends on your individual case.
What happens if I miss the deadline?
Under this rule, the exemption is no longer available. Compulsory insurance continues, and you remain in the student scheme. That is why the three-month deadline is the most important date.
Can a consultation help me decide?
A personal assessment can help you check tariffs, deadlines and proof together. How a consultation at Academycon works is described on How we work.
What to do now
- Find the date of your enrolment and calculate the three-month deadline from it.
- Clarify your other cover in case of illness and get the proof confirmed in writing.
- Compare the costs and benefits of both systems, for example with the German guide Krankenversicherung als Student (in German).
- Submit the application on time and keep a complete copy.
- After the decision, check that the fund has received all documents.
