Disability insurance (Berufsunfähigkeitsversicherung, BU) for law students protects your future income if you can no longer work in your profession for health reasons. For law students the question is especially sensitive: while you are still studying, the policy first has to define which occupation it uses as the basis. This guide explains how to recognise that classification, what drives the premium, and how to answer the health questions carefully.
Short answer: Last updated: October 2026. There is no reliable premium figure for law students, because the price depends on your age at entry, your health, the pension amount, the term and the insurer. What matters most is how your studies are classified in the contract. Ask in writing before you sign whether your future profession or your student status counts.
Key points
- Under section 172 (2) of the German Insurance Contract Act (VVG), occupational disability means you can no longer, for an extended period, carry out your last occupation because of illness, injury or age-related wear.
- The statute says nothing specific about students. The classification comes from the policy terms and the insurer’s assessment.
- Clarify before you sign whether the policy relies on your future career as a fully qualified lawyer or another career path.
- The premium depends mainly on age at entry, health, the pension amount and the term. There is no flat rate.
- Answer all health questions completely and truthfully.
What does the law say about occupational disability?
The definition is in section 172 (2) of the German Insurance Contract Act (VVG). What counts is your last occupation as it was designed before any health impairment. If you do not yet have a job, there is no automatic reference point, and this is where the insurer’s terms come in.
Under section 172 (3) VVG, the parties may additionally agree that a referral to other work only applies if that work matches your training, your abilities and your previous social position. This clause decides which career paths the insurer treats as reasonable, which makes it central for graduates.
How is a law degree classified?
Insurers assign students without work experience to an occupational group. For law students several readings are possible: the studies themselves, the route through the state examinations and the clerkship (Referendariat), or a career outside the classic legal path. The table lists the points to clarify before you sign.
| Check | Why it matters | What to do |
|---|---|---|
| Classification in the application | It determines the occupational group and the terms that apply | Ask in writing and keep the answer |
| Future career goal | The route through the state examinations and the clerkship is long and has distinct phases | Check whether the policy refers to your career goal or to your studies |
| Clerkship (Referendariat) | The preparatory service has its own status and its own rules | Read in the policy how this period is assessed |
| Move to public administration or business | A referral to other work only applies if it is agreed | Check the referral clause and social position wording |
What does disability insurance cost for law students?
There is no reliable figure that applies to all law students. The premium follows from age at entry, health, occupational group, pension amount and term. A comparison only makes sense when the terms are comparable.
A worked example of the coverage gap. Assumption: you want 2,000 euros per month available if you become unable to work. Assumption: the disability pension is 1,000 euros per month. The gap is then 1,000 euros per month. Whether and how the pension is taxed is decided case by case by the competent tax office.
Which health questions do you have to answer?
The application asks about diagnoses, treatment and medication over recent years. Answer every question completely and truthfully. If information is incorrect or incomplete, the insurer can assert rights, for example withdrawal from the contract. For more on the review process, see our glossary on health insurance for students.
- Write down doctor visits, diagnoses and time periods before you fill in the form.
- Read every question in full, including those about symptoms that were never treated.
- Do not guess. If a term is unclear, ask and note the answer.
- Keep a copy of the completed application.
When does it make sense to sign while studying?
An early policy can make sense while you are healthy and the classification can be settled before your career path is fixed. Against signing early: your budget may be tight during studies, and the classification can remain unclear through the clerkship or your first job. If you weigh both, choose terms that still work if your career goal changes.

Frequently asked questions
Does disability insurance pay out if I am not working during my studies?
That depends on the terms. Under the law, occupational disability is tied to the last occupation you exercised. If you have no occupation yet, the contract decides which activity counts, so the classification in the contract is the most important point.
Does the policy still apply after the clerkship?
That depends on the contract and on how your career develops. If you later become a civil servant, you often have a different form of cover for inability to serve. That is a separate topic. For the teacher track, see teacher training insurance from studies to traineeship.
Do I have to report a change of subject?
A change can affect the classification. Whether and when you must report changes is set out in the policy terms. Ask before you sign and keep the answer.
Is it worth taking out cover in the first semester?
That depends on your budget, your health and your goal. Premiums generally rise with age at entry, which is a tendency rather than a promise, because every application is assessed individually.
What if I forgot something in the health questions?
The insurer can then assert rights depending on the situation. Report the gap as soon as you notice it and ask for written confirmation of the correction. For case-specific questions, consumer advice centres such as the Verbraucherzentralen can help.
What to do next
- Note your subject, your career goal and any existing health information.
- Ask the insurer in writing how your law degree is classified.
- Compare the occupational group, the referral clause and the exclusions, not only the premium.
- Answer the health questions completely and keep copies.
