Being unemployed after your Referendariat (the legal or teacher traineeship that follows the state exam) catches many graduates off guard. Whether you receive unemployment benefit (Arbeitslosengeld, ALG I) depends less on your degree than on your insurance periods. If your traineeship is a probationary civil servant relationship (Beamtenverhältnis auf Widerruf), your civil servant health aid (Beihilfe) also ends with it, and your health insurance has to be arranged again.
Short answer: According to the German government, a probationary civil servant relationship does not establish a claim to unemployment benefit. You need at least twelve months of compulsory insurance employment within the last 30 months. Health insurance must be continuous, and while you receive ALG I the statutory health insurance (GKV) covers you as a compulsory member. Last updated: October 2026.
The essentials in brief
- A claim to unemployment benefit requires an entitlement period (Anwartschaft): at least twelve months of compulsory insurance employment within the framing period (Rahmenfrist) of 30 months (§§ 142 and 143 SGB III).
- According to the Bundestag answer 19/13149 of 11 September 2019, a probationary civil servant relationship means exemption from insurance and creates no claim to unemployment benefit.
- If you receive ALG I, you are a compulsory member of the statutory health insurance (§ 5 para. 1 no. 2 SGB V).
- Without ALG I you must insure yourself voluntarily. For 2026 the minimum contribution for health insurance is 222.80 euros per month.
- Whether you receive benefit during the summer holidays is decided case by case by the Federal Employment Agency (Agentur für Arbeit).
Does my time in the Referendariat count toward unemployment benefit?
That depends on your legal status during the traineeship. Depending on the German state, you are either a probationary civil servant or you are in a public-law training relationship (öffentlich-rechtliches Ausbildungsverhältnis). In some states you can choose. The German government stated in 2019 that a probationary civil servant relationship leads to exemption from insurance and therefore creates no claim to unemployment benefit (Bundestag, Drucksache 19/13149).
For the entitlement period, the periods before and after the traineeship therefore matter most. The table shows what typically counts:
| Period | Example | Effect on the entitlement period |
|---|---|---|
| Probationary civil servant status | Referendariat as a probationary civil servant | Exempt from insurance, does not count |
| Salaried employment | Substitute post at a school | Compulsory insurance, counts |
| Working student job | Part-time job alongside studies | Exempt from unemployment insurance, does not count |
| Full-time job before the traineeship | Salaried work in the private sector | Compulsory insurance, counts if it falls within the 30 months |
Many graduates work on fixed-term substitute contracts after the state exam. Such periods count if they were subject to compulsory insurance. Your payslips or the employer notifications to social insurance show whether that was the case, so keep them safe when the contract ends.
How do you check your claim to unemployment benefit?
- Define the framing period: it covers the 30 months before the day on which all other conditions are met. Assumption: the claim arises on 1 October 2026. The framing period then reaches back to about 1 April 2024.
- Add up the compulsory insurance months: periods in salaried employment count, and at least twelve full months must come together.
- Set aside periods as a civil servant: according to the German government, they do not feed into the entitlement period.
- Register on time: register as job-seeking as soon as the end is foreseeable. A late registration can have disadvantages.
A special rule applies to the framing period. It does not reach back into an earlier framing period in which you had already fulfilled an entitlement period (§ 143 para. 2 SGB III). If you already built up a claim earlier, the new calculation starts later. The Federal Employment Agency checks this against your insurance data.
What happens to your health insurance?
When your civil servant relationship ends, your entitlement to the civil servant health aid ends too. You then need cover that connects seamlessly, because a gap can become expensive. If you want to understand the switch between systems, see our guide on health insurance between your state exam and training.
While you receive ALG I, you are a compulsory member of the statutory health insurance. Contributions are then based on the unemployment benefit rather than your former salary. Without ALG I you can join the statutory insurance voluntarily. For 2026 a minimum contribution applies, based on a minimum contribution basis of 1,318.33 euros per month.
Assumption: you are voluntarily insured, have no children, and are older than 23. Then the health insurance costs 222.80 euros and the long-term care insurance 55.37 euros, which adds up to 278.17 euros per month. Your insurer’s additional contribution can differ (source: GKV-Spitzenverband, fact sheet on calculation variables 2026, status 1 January 2026).
Private health insurance is also possible. It usually requires a health check, and its premiums depend on the tariff and your health rather than on your income.
What applies during the summer holidays?
Unemployment during the summer holidays mainly affects teachers on fixed-term contracts. In 2019 the German government said it had no findings on the reasons. It views the practice critically when re-hiring after the holidays is already foreseeable (Bundestag Drucksache 19/13149).
The Federal Employment Agency decides case by case whether you receive benefit in the holidays. What matters is the exact contract wording, any re-hiring commitment (Wiedereinstellungszusage) and whether an employment relationship continues. Keep all contracts, notices and letters from the school authority.
Frequently asked questions
Will I receive unemployment benefit if I only have the Referendariat behind me?
Often not. If you had no further compulsory insurance employment after the traineeship, you usually do not meet the entitlement period. According to the German government, time as a probationary civil servant does not count. Have your case checked concretely by the Federal Employment Agency.
Should I arrange my health insurance before the traineeship ends?
Yes, that is sensible. Once you know when your civil servant status ends, you can request offers early and avoid gaps. The civil servant health aid ends with the service relationship, so your cover has to be in place without interruption afterwards.
What happens if I quit my job myself?
Quitting on your own initiative can lead to a blocking period (Sperrzeit), during which no unemployment benefit is paid. The Federal Employment Agency checks case by case whether a blocking period applies. If a fixed-term contract simply ends, this question usually does not arise.
How high is unemployment benefit?
According to § 149 SGB III, unemployment benefit is 60 percent of your net pay as calculated for benefit purposes in the last months, or 67 percent if you have at least one child. The Federal Employment Agency calculates the exact amount from your earnings, so bring your pay statements.
Can I take a job during the holidays anyway?
That depends on the contract and your claim. Report every employment and every income to the Federal Employment Agency before you start, so no overpayment arises.
So what should you do now?
- Collect your insurance periods: list all employment of the last 30 months with start, end and type of contract.
- Clarify health insurance: before your civil servant relationship ends, request offers for statutory or private cover and check the seamless connection.
- Register as job-seeking early: as soon as the end of your contract is foreseeable, register with the Federal Employment Agency.
- Have your claim checked: bring employment contracts, pay statements and service certificates.
- Keep your documents: contracts, notices and letters from the school authority will be needed for queries.
