If you came to Germany on a student visa, your residence is tied to your studies. When you break off your studies, the first question is what happens to your residence permit. This guide explains what the permit depends on, which deadlines the Residence Act sets, and where you get a binding answer in your individual case.

Short answer: A residence permit for full-time study under section 16b of the Residence Act depends on the purpose of study. If you break off your studies, that purpose lapses, and the competent Foreigners’ Authority decides on the consequences for your permit in each case. The law expressly sets a period of up to nine months to obtain a new admission if the permit is withdrawn or revoked for reasons you are not responsible for. Last updated: November 2026. This guide is general information, not individual advice.

Key points

  • Your residence permit for study is linked to admission and to the purpose of study. The Foreigners’ Authority decides whether and how a break-off has an effect.
  • Under section 16b subsection 2, the permit is generally valid for two years. If the course lasts less than two years, it is issued only for the length of the study.
  • If the permit is withdrawn or revoked for reasons you are not responsible for, section 16b subsection 6 requires that you be given up to nine months to obtain admission at another institution.
  • The grounds for expiry in section 51 subsection 1 numbers 3 to 7 range from withdrawal and revocation to expulsion and departure.
  • A break-off is not expressly listed in that catalogue, so the authority assesses it case by case.
  • Contact the Foreigners’ Authority early and ask for the current position in writing.

What does the Residence Act say about study?

For full-time study at a state or officially recognised university, a residence permit is issued if you have been admitted. This sentence from section 16b subsection 1 explains why your residence is tied to your admission. The permit is therefore not a general residence title but has a clearly defined purpose, and that purpose is exactly what comes into view when you break off.

According to section 16b subsection 2, the permit is generally valid for two years and should not fall below one year. It is extended only if the purpose has not yet been achieved and this is possible within a reasonable time. For short courses there is a special rule: if the study lasts less than two years, the permit is issued only for the duration of the study. If you are on a short programme, know your permit and end date early.

What happens to your residence after a break-off?

The answer depends on the individual case. The law describes when a permit expires or can be withdrawn and revoked. Section 51 subsection 1 numbers 3, 4 and 5 name withdrawal, revocation and expulsion. Number 6 concerns departure for a reason that is not merely temporary, and number 7 concerns departure without return within six months or within a longer period set by the Foreigners’ Authority.

A break-off is not expressly listed in this catalogue. Whether it triggers a ground for expiry, or what consequences it has, is therefore assessed by the Foreigners’ Authority on the basis of the individual case and the legal framework. Do not wait. Anyone who reacts only after months loses room to act, especially when a deadline is already running.

Which steps help you gain time?

SituationWhat you should check
You are considering a break-offGet advice from the university and the Foreigners’ Authority before you are deregistered. Deregistration affects insurance and reporting duties, as the guide on deregistration (in German) explains.
You are changing universityAdmission at another institution must match the purpose of your permit. The Foreigners’ Authority clarifies how a change works, and rules and deadlines for extending a student visa (in German) helps you classify it.
The university takes back your admissionCheck whether the period of up to nine months for a new admission applies. The law provides it for cases you are not responsible for.
You have to leave GermanyIf you leave, keep the six-month rule under section 51 subsection 1 number 7 in view and plan your return precisely.

A break-off also affects health insurance. Which steps to take there is explained in our guide on health insurance after a break-off (in German). Both topics should be planned together so that no gap appears.

Which questions should you ask the Foreigners’ Authority?

Prepare a short list before you go to an appointment. Ask which residence title still applies after the break-off, whether a deadline is running, whether a change to another university preserves the purpose, and which documents the authority needs. Bring your admission papers, a statement on the status of your studies and your passport if an appointment is due.

Ask for information in writing wherever possible. A verbal answer helps little if it cannot be proven later, for example when you apply for an extension or a change. Note the date, the name of the person and the content of the conversation so that you can refer to it later.

Also consider timing. A conversation in the last weeks before deregistration is usually less useful than an appointment before the decision is made. If you are weighing several options, such as changing university or breaking off, ask for an assessment of each so that you can compare them.

Frequently asked questions

Do I have to leave Germany immediately after a break-off?

That cannot be answered in general terms. The permit is linked to the purpose of study, and the Foreigners’ Authority examines the individual case. Contact the authority early and ask for the position in writing, rather than relying on assumptions from friends.

Does the nine-month period always apply?

No. Under section 16b subsection 6, it applies where the permit is withdrawn or revoked for reasons you are not responsible for. Whether a break-off falls under this condition is for the authority to assess. The period is therefore a protective rule and not an automatic extension.

Can I keep working after a break-off?

Whether and what work you may do depends on the permit you hold afterwards. The rules on employment for students are set out in section 16b subsection 3. A work permission after a break-off, however, is a matter for the Foreigners’ Authority and is not automatically granted.

What happens if I leave after the break-off?

Under section 51 subsection 1 number 7, the permit expires if you leave and do not return within six months or within a longer period set by the Foreigners’ Authority. Plan your return with that date in mind and clarify the deadline in advance.

Which authority is responsible?

For visa matters before entry, the German diplomatic mission abroad is responsible. Within Germany, the Foreigners’ Authority at your place of residence is the right contact. If in doubt, ask first at the office that issued the permit.

What to do now

  1. Clarify with the university which steps apply to a break-off or a change.
  2. Contact the Foreigners’ Authority at your place of residence and describe the position in writing.
  3. Note all deadlines, above all the six-month period for a return and the nine-month period for a new admission.
  4. Clarify insurance and reporting duties before you are deregistered.
