A tax return without income is usually not compulsory for students in Germany. It can still pay off if wage tax was withheld from a part-time job. Whether you must file and whether it is worth the effort depends mainly on your annual income and on the wage tax (Lohnsteuer) your employer has already deducted.

Short answer: Students whose income stays below the basic allowance (Grundfreibetrag) of 12,348 euros for 2026 usually do not have to file a German income tax return. A voluntary return mainly pays off if wage tax was withheld and no income tax is due. Last updated: October 2026.

The most important points in brief

  • Students with a part-time job usually have no duty to file as long as their income stays below the basic allowance.
  • A return brings money back mainly when wage tax was withheld. Only then is there something to refund.
  • The basic allowance for 2026 is 12,348 euros per year under § 32a EStG (status 2026).
  • The employee flat-rate deduction of 1,230 euros under § 9a EStG (status 2026) is applied without individual proof.
  • Several jobs at the same time, or non-wage income above 410 euros that is not subject to wage tax, can create a filing duty even with low income.
  • A refund is possible only within the assessment period (Festsetzungsfrist), which is four years (§ 169 AO).

When is a tax return compulsory?

For people who are not assessed jointly, the duty follows § 56 of the German Income Tax Implementation Ordinance (EStDV). In short, a return is due if your income exceeds the basic allowance and there is no wage income with tax deducted. If wage income with tax deducted exists, the question is whether an assessment under § 46 para. 2 EStG is possible. The table shows typical cases for students.

SituationDuty to file?
Only one mini-job or student assistant job, income stays below 12,348 eurosNo, filing is voluntary
Income without wage tax deduction above the basic allowanceYes (§ 56 EStDV)
Jobs with several employers at the same time (§ 46 para. 2 no. 2 EStG)Yes
Non-wage income above 410 euros that is not subject to wage tax (§ 46 para. 2 no. 1 EStG)Yes
Voluntary return to get withheld wage tax back (§ 46 para. 2 no. 8 EStG)No, but possible

Is the return worth it for you? How to check

The easiest check uses your own papers. The wage tax certificate (Lohnsteuerbescheinigung) from your employer shows your gross pay and the wage tax withheld. If it shows zero euros of wage tax, there is nothing to get back. An example for orientation is in our guide on getting wage tax back.

Assumption: In 2026 you had only one part-time job, 180 euros of wage tax were withheld during the year, and you had no other taxable income. If the tax office finds that no income tax is due, the withheld wage tax is refunded. Only the assessment shows whether this applies to you.

How long can you claim a refund?

For taxes such as income tax, the assessment period is four years (§ 169 para. 2 AO). It generally starts at the end of the year in which the tax arose (§ 170 para. 1 AO). A refund for an earlier year can therefore only be claimed within this period.

The filing deadline for the tax return without a tax adviser is set in § 149 AO and is binding for compulsory returns. For the 2025 tax year, the statutory deadline without a tax adviser was 31 July 2026 (status October 2026). Whether the tax office still accepts a return after this date should be confirmed with the responsible office.

Which documents do you need?

For the return you mainly need the papers that show your pay and deductions. Collect them in one folder before you file, so you do not have to enter amounts from memory.

  • Wage tax certificates (Lohnsteuerbescheinigungen) from all employers for the year, including short mini-jobs.
  • Payslips, if the details in the certificate are unclear.
  • Receipts for work-related expenses, such as work equipment, specialist literature or travel to work, if together they exceed the flat-rate deduction.
  • Your bank details, so that a refund can be transferred.

What changes with several jobs?

If you hold two employments at the same time, the second employer may apply tax class VI (§ 39e para. 5a EStG). Wage tax can then be higher than the income tax you finally owe. Tax class VI is intended for the second and further wage payments (§ 38b para. 1 no. 6 EStG). Overpaid wage tax is recovered in the assessment that is required with several employers (§ 46 para. 2 no. 2 EStG).

Frequently asked questions

Do I have to file a tax return as a student without income?

Usually not. The duty does not depend on being a student but on whether your income exceeds the basic allowance or whether you have several jobs or other taxable income. If none of this applies, filing is voluntary.

Will I get money back if I only have a mini-job?

That depends on whether your employer withheld wage tax. You can see this on your payslip and in the wage tax certificate. If no wage tax was deducted, there is nothing to refund.

Is it worth filing for small amounts?

This is a trade-off between effort and benefit. For small amounts, a return often only pays off if you can prove work-related expenses above the flat-rate deduction. More on this is in our guide on tax returns for students.

How long can I still apply for a refund?

The assessment period is four years (§ 169 para. 2 AO). The exact end date for one year depends on the start of the period under § 170 AO. If you are unsure, ask the responsible tax office before a deadline passes.

What to do now

  1. Find your wage tax certificate and payslips for the relevant year.
  2. Check your own work-related expenses. Only costs above the flat-rate deduction of 1,230 euros add a real benefit.
  3. File a voluntary income tax return with a request for assessment if wage tax was withheld.
  4. Keep the assessment period in mind and check the tax assessment notice when it arrives.
