Anyone who holds a doctorate from another country asks whether, and in which form, it may be used in Germany. In principle this is possible if the degree meets certain conditions. The rules are set by state law, so the exact answer depends on the federal state. This guide explains the conditions, the exceptions and the evidence you need.
Short answer: A foreign doctoral degree may be used in Germany if it was originally awarded, rests on a completed and examined course of study, and was not bought. According to the guidance of the Bavarian State Ministry (last updated January 2023), no approval is needed in Bavaria. Other states can differ, so the law of your state of residence applies.
The Key Points at a Glance
- Using a foreign doctoral degree is governed by state law. In Bavaria it is permitted by law without approval (last updated January 2023).
- The degree must have been originally awarded by a university or body recognised in the country of origin.
- Degrees bought for payment, professional doctorates and degrees below the third Bologna level are excluded.
- Conversion into a German degree (Nostrifikation) is excluded for degrees from non-EU countries.
- The award certificate is the most important proof, because it shows which form of the title is permitted.
Which Conditions Must a Foreign Doctorate Meet?
The Bavarian ministry guidance sets out the basic rules. The table below summarises them and shows what to check when you assess your own degree.
| Check | What applies | What to verify |
|---|---|---|
| Award | Originally awarded by a university or body recognised in the country of origin | Name of the awarding university and its recognition at home |
| Study | Actually completed and properly examined | Course of study, examination records |
| Acquisition | Not acquired for payment | Whether payments were made for the award |
| Type of degree | No professional doctorate | Whether the degree came from a scientific procedure |
| Level | Third Bologna level, no small doctorates | Country of origin and date of admission |
| Conversion | Nostrifikation excluded (non-EU countries) | Do not apply for conversion into a German degree |
The table does not replace an individual check. It does show why the award certificate and the type of procedure are so decisive. A degree can be a doctorate in form and still not be usable in Germany if one of the conditions is missing.
Is an Approval Required for Using the Title?
In Bavaria no approval is needed. The use of the title is permitted by law, and applications or administrative acts do not apply. The exception is people entitled under the Federal Expellees Act (Bundesvertriebenengesetz). They can apply for a free approval to use the title in German form if equivalence is proven.
Whether other states follow the same approach must be checked with the responsible authority in your state. The guidance expressly notes that the legal position can differ in other states.
Are There Special Rules for Certain Countries?
Certain doctorates from Russia, Australia, Israel, Japan, Canada, the United States and the United Kingdom are subject to special rules under decisions of the Standing Conference of the Ministers of Education and Cultural Affairs (KMK). According to the guidance, these lists are exhaustive and may not be applied by analogy to other degrees. If your degree comes from one of these countries, read the current version of the decisions carefully.
Small doctorates from the Czech Republic and Slovakia form a separate case. According to the guidance, they are excluded if admission took place after 1 September 2007. For admissions before that date the situation can differ, so check the date of your admission.
Which Evidence Do You Need?
The most important proof is the original award certificate, because it shows the form in which the degree may be used. The database anabin (in German) of the Standing Conference provides information on the original forms of award, official abbreviations and German translations. It does not replace the certificate, but it helps with classification.
- Check the award certificate and note the title, form of award, university and date.
- Look up the form of award in anabin and compare it with the certificate.
- If you are unsure, contact the responsible office in your state and include a copy of the certificate.
- For entries on a passport or identity card, also contact your local registration authority, which is responsible for these documents according to the guidance.
- Use the chosen form consistently in your CV and applications.
Does This Also Apply to Professional Titles?
No. The doctoral title is separate from the legal protection of certain professional titles. The guidance gives as examples the professional title of engineer, which in Bavaria is regulated by the Government of Swabia, and the title of architect, for which the Bavarian Chamber of Architects is responsible. These rules apply in addition to the doctoral title.
Frequently Asked Questions
Do I need to have my foreign doctorate recognised?
For using the title in Bavaria, the guidance says no approval is needed. An equivalence check for an employer or for a course of study is a separate procedure with its own rules. What you need depends on what you want to use the degree for.
Can a title from a non-EU country be converted into a German doctorate?
No. According to the guidance, nostrified degrees from non-EU countries and conversion into German degrees are excluded. You therefore use the form that follows from the award certificate.
May I use only “Dr.” as an abbreviation?
For EU and EEA doctorates earned in a scientific doctoral procedure, “Dr.” without a subject suffix and without the country of origin is a permitted alternative. Using both abbreviations together is not permitted. For other degrees, the original form or the abbreviation approved in the country of origin applies.
Do these rules apply in the same way in every federal state?
No. The guidance describes Bavarian law, which rests on the Bavarian Higher Education Innovation Act and supplementary KMK decisions. Other states have their own higher education laws and can regulate use differently. Check the rules of your state before you use the title.
What if I do not have the award certificate?
Without the certificate it is hard to prove the permitted form, because the form follows from the document. Contact the awarding university to ask for a copy or a confirmation. Ask the responsible office in your state which replacement evidence it accepts.
What to Do Next
- Find the award certificate and note the form of the degree.
- Check the form of award in anabin and compare it with the certificate.
- Ask the responsible office in your state about the rules that apply there.
- Use the title in your CV and applications only after this is clarified.
