A paternity acknowledgement determines who is legally the father of a child, and with it who owes the child maintenance. Many young fathers only learn at the birth which obligations apply to them. Much of this is clearly regulated, and the most important questions can be answered in advance.

Short answer: Under section 1594 of the German Civil Code (BGB), paternity can be acknowledged even before the child is born. The acknowledgement takes legal effect only from the moment it becomes effective. It is ineffective as long as the paternity of another man exists. Maintenance duties follow from the family relationship under section 1601 BGB. Last updated: November 2026.

The key points at a glance

  • An acknowledgement is permitted before the child is born.
  • It takes legal effect only from the point in time when it becomes effective.
  • An acknowledgement made subject to a condition or a time limit is ineffective.
  • As long as another man is the legal father, the acknowledgement cannot become effective.
  • Maintenance follows the relationship in the direct line and the financial capacity of the father.

What does a paternity acknowledgement do legally?

With the acknowledgement, the man becomes the legal father. The consequences concern maintenance, custody and contact, and the relationship with the child as a whole. The acknowledgement is therefore more than a formality. It determines who bears a father’s obligations and creates the basis for the child’s claims.

The legal effects only apply once the acknowledgement has become effective. This is the central point that many people underestimate. A father who acknowledges before the birth therefore carries the obligations only from the moment the acknowledgement becomes effective.

When is an acknowledgement ineffective?

The law sets clear limits. The table summarises the rules from section 1594 BGB as they appear on gesetze-im-internet.de.

SituationConsequence for the acknowledgement
The acknowledgement has become effectiveThe legal effects can be asserted from that point
The paternity of another man still existsThe acknowledgement is not effective
The acknowledgement is subject to a condition or a time limitThe acknowledgement is ineffective
The acknowledgement takes place before the child is bornThe acknowledgement is permitted

The rule on time limits matters in practice. A father cannot declare that he acknowledges only after a certain date or under the proviso of an event. The declaration must be clear and unconditional.

Do I have to pay maintenance for my child as a young father?

Under section 1601 BGB, relatives in the direct line owe each other maintenance. This means that a father and his child are, in principle, mutually obliged. The exact amount, however, is not determined by this provision alone. It depends on the father’s income, the age of the child and the circumstances of the individual case.

For the calculation, courts and youth welfare offices use reference values, such as the Düsseldorf Table. It is published by the Higher Regional Court of Düsseldorf and is updated regularly. Ask the competent office for the current version, because the amounts can change. A detailed explanation of the calculation steps is in the German article Kindesunterhalt berechnen: Was Eltern nach der Trennung zahlen.

How does the acknowledgement work in practice?

In Germany, the acknowledgement is usually declared before a competent body, such as the youth welfare office or a notary. Find out in advance which body is responsible in your region and which documents you need to bring. The body will also tell you whether costs apply and how much they are.

The mother is also involved in this process. Clarify in advance whether her consent is required for your declaration, and discuss the matter with her before you book an appointment. An open conversation usually saves time and avoids later misunderstandings.

Why early clarity often helps

Those who clarify paternity early create reliability for the child, for the mother and for themselves. Many conflicts arise not from bad intentions but from uncertainty about what the law requires and who carries which responsibility. A clean acknowledgement removes this uncertainty, at least on the legal question.

At the same time, early clarification is not a financial decision in advance. The amount of maintenance depends on circumstances that can change, such as income or the age of the child. It is therefore sensible to review the figures regularly and report changes in time.

Frequently asked questions

Can I acknowledge paternity before the birth?

Yes. The law expressly allows acknowledgement before the child is born. The effects only begin from the time the acknowledgement becomes effective. An early acknowledgement therefore creates clarity without bringing the obligations forward.

What happens if another man is considered the father?

Then an acknowledgement is not effective for as long as that other man’s paternity exists. How the legal position develops depends on the individual case. Advice from the competent office helps to determine the next step.

Can I attach a condition to the acknowledgement?

No. An acknowledgement subject to a condition or a time limit is ineffective under the law. The declaration must be unambiguous so that its effects occur with certainty.

Does the same apply if we are not married?

The rules we cite from section 1594 BGB do not mention the marital status of the parents. An acknowledgement is therefore possible even if you are not married. What counts are the requirements of the acknowledgement itself, not the marriage. The question of maintenance in an individual case, however, depends on the circumstances and not on the marital status alone.

Do I have to pay if the mother and I disagree?

Even if the relationship with the mother is difficult, the legal question remains separate. The acknowledgement and the maintenance obligation are two different topics. If there is a dispute over the amount, the competent court decides in case of doubt. Legal advice can be useful before you offer any payments.

Does this also apply while I am still in education?

The obligation exists in principle regardless of whether you are studying. The amount, however, depends on actual income and financial capacity. If you study or do an apprenticeship, tell the body that sets the maintenance so that the calculation is correct.

What does the acknowledgement cost?

The costs depend on the body where you make the declaration and on the form of certification. Ask in advance so that you can plan. Only the competent body can give a binding answer, not a general guide.

What to do now

  1. Find out whether the paternity has already been acknowledged or whether another man is considered the father.
  2. Ask the competent body which form and which documents the acknowledgement requires.
  3. Discuss the appointment and the declaration with the mother before the acknowledgement is recorded.
  4. Have the maintenance questions answered in advance, so that you know what to expect.
