A mobile phone contract often runs longer than people expect, and cancelling frequently fails on notice periods or formalities. This guide explains how to approach ordinary cancellation, when a special termination right under the German Telecommunications Act may apply, and how to make your notice verifiable.

Short answer: Ordinary cancellation follows the term and notice period in your contract. A special right to terminate exists under section 57 of the Telecommunications Act if the provider changes the contract unilaterally. You may then cancel without a notice period and without costs, within three months of receiving the notification. Fixed deadlines for your tariff are stated in the contract. Key points at a glance

  • Ordinary cancellation follows the term and notice period set out in your contract.
  • A special termination right may arise if the provider changes the contract unilaterally.
  • You may then cancel without a notice period and without costs, within three months.
  • The provider must inform you one to two months in advance and point to your termination right.
  • Keep proof of when your cancellation was received and what it said.

Ordinary cancellation: check the term and notice period

Ordinary cancellation is the normal case. It takes effect when the contract term ends, and the notice period in the contract determines the latest date by which you must send your declaration. You can therefore read the exact date only from your own documents. There is no single figure that applies to all providers.

ItemWhere you find it
Start of contract and minimum termContract documents or customer account
Notice periodContract and general terms and conditions
Renewal ruleContract, often with automatic renewal after the term
Cancellation routeNote in the contract or on the provider’s website

Once you have calculated the date, note it with a reminder. Many contracts renew if you do not cancel in time, and the notice period then starts again.

Special termination under section 57 of the Telecommunications Act

If the provider changes a contract unilaterally, this can give you a special right to terminate. The provision presupposes that the provider has reserved that change in its terms and conditions and uses it. According to the wording, you may then cancel without a notice period and without costs. You must make the declaration within three months of receiving the proper notification.

Whether a price adjustment falls under this depends on how the contract regulates it. What matters is that the change is implemented through a unilateral amendment of the contract. Check whether a corresponding clause appears in your terms and compare it with the provider’s letter.

The exceptions matter. The right does not apply if the change is only advantageous, remains purely administrative without negative consequences, or is legally mandatory. An increase in the charge is usually not advantageous for you, so it generally does not fall under these exceptions.

RequirementWhat the law provides
NotificationAt least one and at most two months before the change takes effect, on a durable medium
Content of the notificationThe content and timing of the change, and your right to terminate
Notice periodNo notice period and no costs
Time windowWithin three months of receiving the notification

Reduction of charges and extraordinary termination

A second level concerns the service itself. If there are significant, lasting or recurring deviations between the service actually provided and the service agreed, you may reduce the charge proportionally or terminate extraordinarily without a notice period. For internet access services, only deviations determined by certification count. Section 314 subsection 2 of the German Civil Code applies accordingly to the termination. The statute does not set a fixed period.

This second level has nothing to do with a price increase. It requires that the service really falls short of what was agreed. Document deviations before you rely on them.

Step by step: how to cancel

  1. Check the term, the notice period and the cancellation route in your contract.
  2. Establish whether a unilateral change has taken place, and note the date of the notification.
  3. Write the cancellation clearly, with contract number, phone number and the desired end date. Cite section 57 of the Telecommunications Act if you rely on it.
  4. Send the cancellation by a route that leaves proof, and keep the receipt.
  5. After the contract ends, check that direct debits really stop.

Checklist before sending

PointWhy it matters
Contract number statedThe provider can then assign the declaration to the contract clearly
End date namedWithout a date it remains open when the contract ends
Proof securedIn a dispute you need the record of sending and receipt
Phone number clarifiedIf you want to keep the number, arrange the switch beforehand

What students should keep in mind

Many students change their place of residence or university during their studies. A contract can then quickly become unsuitable. Before you cancel, check whether another tariff fits your situation, and end the old contract only once you have an alternative. An overview of contract models and prepaid cards is available in Prepaid oder Vertrag fürs Handy: Was sich für Studierende lohnt (in German).

If you only need a contract for a short time, check the minimum term before you commit. Cancelling at the end of the term is usually straightforward, whereas early cancellation is not.

Frequently asked questions

Can I cancel without a notice period if the price rises?

That depends on the contract clause. If the provider implements the increase through a unilateral change and you were notified in good time, a special right under section 57 of the Telecommunications Act may exist. How this works in detail is explained in Preiserhöhung im Handyvertrag: Wann du ohne Frist kündigen darfst (in German).

Do I have to send the cancellation in writing?

Many providers offer a route through the customer account. Use the channel provided and keep the confirmation. If no confirmation arrives, send the cancellation additionally by a route that leaves proof, so that you can document receipt.

What should I do if the provider does not respond?

Document the sending and the date, review the contract again and request a written confirmation. A confirmation is the best evidence that the contract ends. If no answer comes, be careful about stopping direct debits with your bank, and obtain legal advice first.

Does the contract renew automatically?

Many contracts renew if you do not cancel in time. Plan the deadline with your calendar so that you do not miss it. Whether and how your contract renews is stated in your documents.

Does the special termination right apply to prepaid cards?

Prepaid contracts generally do not have a fixed term in the classic sense. Whether a special rule applies depends on the provider’s conditions. Check its terms and conditions and ask if something is unclear.

How to proceed now

  1. Read the term, notice period and renewal rule in your contract.
  2. Check whether the provider notified you of a change, and note the date.
  3. Send the cancellation by a route that leaves proof and keep the receipt.
  4. After the end, check that no further amounts are debited.
