How the Jobcenter checks your rent decides one of the largest items of the month under Grundsicherung. Section 22 SGB II governs: the actual costs of accommodation and heating are recognised as far as they are appropriate. Since 1 July 2026 a further ceiling at one and a half times the abstractly appropriate costs applies.

This guide describes the check from the Jobcenter’s point of view: which costs count, when they are inappropriate, what happens with a request to reduce costs and which protective rules exist. It deliberately gives no rent ceilings for individual places, each authority sets its own. For the reform overview see the hub on the new Grundsicherung (in German).

In short: The Jobcenter recognises rent and heating costs at their actual level as far as they are appropriate (section 22(1) SGB II, last updated November 2026). If costs exceed one and a half times the abstractly appropriate amount, they are not recognised. Excessive costs are usually covered for six months at most while a reduction is impossible or unreasonable.

Key points

  • The actual costs of accommodation and heating are recognised as far as they are appropriate.
  • Appropriateness is checked for the approval period. The Jobcenter must inform you if your costs are above it.
  • Since July 2026 recognition is also capped at one and a half times the appropriate costs during the grace period.
  • Costs are also inappropriate if a per-square-metre ceiling is exceeded or the rent brake is breached.
  • On request, or where misuse is likely, the rent share can be paid directly to the landlord.

Which costs does the Jobcenter cover?

Under section 22(1) SGB II, needs for accommodation and heating are recognised at the level of actual costs as far as they are appropriate. These include rent with service charges and heating costs. Refunds and credits attributable to accommodation costs reduce the costs from the following month (section 22(3) SGB II). Refunds relating to household energy are disregarded.

The same principle applies to heating, but the check is separate. Under section 22(10) SGB II the Jobcenter may set an overall appropriateness limit for accommodation and heating and take into account the heating value that would be the maximum recognised on a separate check. How the grace period affects this is in Grace period in Grundsicherung (in German).

How does the Jobcenter check whether rent is appropriate?

The check runs in several steps. The table shows what the law says (last updated November 2026).

StepContent under section 22 SGB II
Abstract appropriatenessThe authority sets for its area which costs are appropriate.
One-and-a-half ceilingCosts above one and a half times the abstractly appropriate amount are not recognised.
Square-metre ceilingCosts are inappropriate if a local per-square-metre ceiling is exceeded.
Rent brakeCosts are inappropriate if the rent exceeds the permitted level under sections 556d to 556g BGB. The landlord must be asked to correct it.
Review periodAppropriateness is checked for the approval period.
InformationIf costs exceed the appropriate level, the Jobcenter informs you about the duration and conditions for recognising them.

The number of people in the household, the place of residence and the local rent level determine the limit. Your Jobcenter tells you where to find the limit that applies to you. Many authorities publish their appropriateness guideline on the website of the district or city.

What happens if the rent is too high?

If the rent is above the appropriateness limit, the Jobcenter usually asks you to reduce the costs. Under section 22(1) SGB II the excess costs are, where a reduction is not possible or not reasonable, usually recognised for six months at most. After the death of a household member a reduction is considered unreasonable for at least twelve months. An uneconomic reduction need not be demanded.

Assumption: The appropriate rent is 450 euros, your rent 520 euros. After the grace period the Jobcenter asks you to reduce it (last updated November 2026, simplified calculation).

PeriodRecognised rentYou pay yourself
During the grace period (ceiling 675 euros)520 euros0 euros
After the request, up to six months with proof of efforts520 euros0 euros
Afterwards, if no reduction succeeds450 euros70 euros a month

Over a year that is 840 euros you would have to bear yourself if the rent is never reduced. Document your efforts to find a cheaper flat: applications, adverts and rejections. They show that a reduction was not possible.

Are there protective rules for tenants?

  • For households with children, higher costs can be recognised in the grace period (section 22(1) SGB II).
  • Unavoidable higher costs can also be recognised in the grace period.
  • In case of rent arrears or energy arrears, the rent share can be paid directly to the landlord (section 22(7) SGB II). The Jobcenter must inform you in writing.
  • Debts can be taken over if this secures the accommodation or homelessness threatens, usually as a loan (section 22(8) SGB II).
  • If an eviction claim for rent arrears reaches the court, the court informs the Jobcenter under section 22(9) SGB II.

If you are thinking of moving, first clarify whether the move makes sense and whether an assurance is needed. A special rule applies to people under 25, see Grundsicherung under 25 and moving (in German).

How can you challenge a wrong rent calculation?

First check in the decision which costs the Jobcenter recognised and which appropriateness limit it used. If the recognised costs differ from your tenancy agreement or service charge statement, object within one month of notification, see Objecting to a Jobcenter decision (in German). Also check whether the decision sets out the appropriateness limit in a comprehensible way. If you want to check housing benefit, see Student housing benefit.

Frequently asked questions

Does the Jobcenter pay my full rent?

Only as far as it is appropriate. If it exceeds the limit, the higher costs are recognised for a limited time while a reduction is not possible or reasonable. In the grace period the ceiling is one and a half times the appropriateness limit.

Where do I find the rent ceiling for my area?

At the competent Jobcenter or the municipality. Each authority sets the limit for its area. There is no uniform nationwide table.

Are heating costs checked separately?

Yes, the appropriateness of heating costs is assessed separately. The authority can, however, set an overall limit for accommodation and heating (section 22(10) SGB II).

Can the Jobcenter pay the rent directly to my landlord?

On request, yes. In case of arrears, or if proper use is not secured, it should do so (section 22(7) SGB II).

What to do now

  1. Read in the decision which accommodation costs were recognised and which limit applies.
  2. Ask the Jobcenter or your municipality for the appropriateness guideline.
  3. Compare rent, service charges and heating with that limit and the ceiling of 150 percent.
  4. Document your efforts to find a cheaper flat if the Jobcenter asks you to reduce costs.
  5. For questions about financial planning, support is available at how we work (in German).
