Whether dog liability insurance (Hundehaftpflicht) is mandatory in Germany is decided by state law. No federal act obliges every dog owner to take out liability insurance. If you move as a student or young professional, you may therefore land in a different regime. This guide shows what can be verified in official texts, which types of rule exist and how to clarify the position in your state. It complements Insurance for students: an overview (in German).
In short: Dog liability insurance is not required nationwide, the federal states regulate it. In Lower Saxony, section 5 of the Lower Saxony Dog Act of 26 May 2011 requires liability insurance for dogs older than six months, with at least EUR 500,000 for personal injury and EUR 250,000 for property damage. For other states the duty is not stated across the board here, so check state law.
Key points
- The duty to hold dog liability insurance is state law. There is no federal act covering all dogs.
- Lower Saxony: duty for dogs over six months, minimum sums under section 5 NHundG EUR 500,000 (personal) and EUR 250,000 (property).
- Some states require insurance for every dog, others only for certain dogs, as Stiftung Warentest also writes (page from October 2025).
- Even without a duty, you are liable as a dog owner for damage your dog causes.
- Private liability insurance usually does not include dogs, your contract terms decide.
Is there a nationwide duty to insure a dog?
No. Keeping dogs is regulated by the states in their own acts and ordinances. These also say whether and for which dogs liability insurance is required. Some states require it for all dogs, others only for certain dogs, for example by size, breed or if a dog has been classified as conspicuous or dangerous. Rules therefore differ depending on where you live.
Regardless of any duty: as the keeper you are liable under the German Civil Code (section 833 BGB, liability of the animal keeper) for damage your dog causes to third parties. Whether insurance protects you depends on the contract. How far dog liability insurance reaches is explained in When a dog bites: what dog liability insurance pays.
What does the Lower Saxony Dog Act say?
The Lower Saxony Dog Act (NHundG) of 26 May 2011 (Nds. GVBl. pp. 130, 184) regulates liability insurance in section 5. The text requires liability insurance for damage caused by a dog if the dog is older than six months. The minimum sum insured is EUR 500,000 for personal injury and EUR 250,000 for property damage. Public-law legal entities and foreign armed forces are exempt for service dogs. The responsible body under section 5 sentence 2 is the municipality. Under section 1(2), the act applies to keepers with residence or a longer stay in Lower Saxony and to walking dogs in the state.
This is directly relevant for students in Göttingen and other Lower Saxony university towns. The version on the ministry’s page carries no consolidated date, so also check the current version in the state’s legislation database or with your municipality.
How do the states differ?
The states regulate this differently. Stiftung Warentest writes that some states prescribe liability insurance for every dog (page of 17 September 2025, last changed 21 October 2025), but names no individual states in the text. Overviews by third parties diverge on individual states, so the table below deliberately shows only the types of rule and no list of states.
| Type of rule | Typical link | What you should do |
|---|---|---|
| Duty for all dogs | Usually an age limit for the dog, in Lower Saxony more than six months (section 5 NHundG) | Take out insurance before registering the dog, check the minimum sums |
| Duty for certain dogs | Breed, size, weight or classification as dangerous | Ask the Ordnungsamt whether your dog is covered |
| No state-wide duty | Rule only for conspicuous dogs or only at municipal level | Still bear liability under the BGB in mind and consider insurance |
Only Lower Saxony is officially verified in this guide. For all other states the duty is therefore not stated across the board here. Look at the dog act or ordinance of your state. Decisive are the current state acts and ordinances, about which the public order office (Ordnungsamt) of your municipality can inform you.
Why check dog liability insurance even without a duty?
Dogs can cause considerable damage, such as bite injuries or road accidents. Without insurance you are liable with your assets. Assumption: your dog causes a road accident in which a person is injured and a vehicle is damaged. Without dog liability insurance, you bear the claims yourself. The example is hypothetical and only shows the risk, it is not a calculation.
If you rent, also check your tenancy agreement. Keeping a dog can be subject to conditions. Costs and benefits of dog liability insurance are covered in Dog liability insurance: costs and benefits. Puppies have particularities regarding the start of cover, see Dog liability insurance from puppyhood (in German).
Does private liability insurance cover the dog?
Usually not. Private liability covers typical everyday risks, damage caused by dogs is often excluded or covered only to a limited extent. Whether your contract is affected is stated in the terms. More on private liability in Liability insurance while studying: how long are you covered through your parents? (in German). A dog in your parents’ household is not automatically covered by their private liability policy.
Frequently asked questions
Is dog liability insurance mandatory in Germany?
Not nationwide. It depends on the state. In Lower Saxony it is required for dogs over six months under section 5 NHundG. For other states the position must be checked in the respective state law.
Does the duty apply if I live in a state only temporarily?
The Lower Saxony Dog Act applies under section 1(2) to keepers with residence or a longer stay in Lower Saxony. In other states the respective state law applies. When you move, ask the Ordnungsamt.
How do I prove my insurance?
Proof is requested differently depending on state and municipality. In Lower Saxony, section 5 sets no express duty of proof towards the authority, but proof of insurance is a condition for the permit to keep a dangerous dog (section 10(1) no. 3). Keep your insurance confirmation at hand.
Are there statutory minimum sums?
In Lower Saxony yes: EUR 500,000 for personal injury and EUR 250,000 for property damage. For other states check the state rule, many tariffs offer higher sums.
What about mixed breeds and rescue dogs?
Depending on the state, rules refer to age, size, breed or classification. The origin of the dog is not decisive. Ask the Ordnungsamt when you register.
What to do now
- Establish in which state your dog is registered or where you stay for longer.
- Check the dog act there or ask the Ordnungsamt about the insurance duty.
- Clarify whether your private liability policy excludes the dog.
- Compare offers by sum insured and terms before you sign.
- Keep the confirmation of insurance for the municipality and your landlord.
