Your gym contract runs on, the fee is debited every month, and you want to stop. Whether you can simply leave depends on the contract. Anyone preparing a cancellation should first check the term, the notice period and the required form before writing anything.

Short answer: Ordinary cancellation of a gym contract depends on the term and the notice period in the contract. For pre-formulated terms, section 309 no. 9 of the German Civil Code (BGB) sets limits: a term of at most two years, renewal only for an indefinite period with at most one month’s notice, and a notice period of at most one month before the term ends. Extraordinary cancellation requires an important reason under section 314 BGB. Status: November 2026; your contract terms take precedence.

Key points at a glance

  • The term and the notice period are in the contract and are the first things to check.
  • For pre-formulated terms, section 309 no. 9 BGB applies: an initial term of at most two years and a notice period of at most one month.
  • Under section 312g BGB, a statutory right of withdrawal exists only for distance contracts and contracts concluded away from business premises.
  • Extraordinary cancellation needs an important reason under section 314 BGB, assessed case by case.
  • A 2016 statement by the Hamburg consumer advice centre did not list moving house yourself as a reason.
  • Cancel in a verifiable way and keep the studio confirmation.

What does your contract say?

Before you cancel, read the contract and the general terms and conditions. There you will find the minimum term, the notice period and the form in which a cancellation must be made. Some studios require a signed letter, others accept a registered letter. Do not rely on memory; rely on the text.

For pre-formulated contract terms, section 309 no. 9 BGB sets fixed limits: a term that binds you for more than two years is invalid. Tacit renewal is only valid if it is for an indefinite period and you can then cancel at any time with at most one month’s notice. A notice period that ends more than one month before the term expires is also invalid. Older contracts may follow different rules, so the text of your own contract is what counts.

CheckWhere to find itWhy it matters
Minimum termContract, section on durationA cancellation before the term ends often does not take effect at once
Notice periodContract or terms and conditionsIt determines the earliest end date
Form of cancellationTerms and conditions, section on cancellationA form that is not observed can make the cancellation ineffective
Start and renewalContract, section on termAutomatic renewal can take effect at short notice

The table shows what you should check in every case. If something is missing, ask the studio in writing for the terms before you end the contract.

Is there a special right of termination?

A special right of termination does not exist automatically. It arises from the contract or from the law. Under section 314(1) BGB, either party can end a continuing obligation for an important reason without observing a notice period. An important reason exists if you cannot reasonably be expected to continue until the agreed end or until the notice period expires. The circumstances of the individual case and the interests of both sides decide. If the reason is a breach of duty by the studio, section 314(2) generally requires a deadline to remedy it or a warning first. You must also cancel within a reasonable time after learning of the reason (subsection 3). In a press release of 1 August 2016, the Hamburg consumer advice centre gives examples of such reasons. They show typical cases as of that date and do not replace an assessment of your own situation.

ReasonAssessment by the Hamburg consumer advice centre (2016)Note
Lasting illnessNamed as a reason; the studio may ask for a medical certificateOnly for lasting illness, not a short one
Relocation of the training siteNamed as a reason, even within the same cityApplies when the studio moves its location
Your own moveNot named as a reasonThe terms may provide otherwise
Unreasonable training conditions or a longer closureNamed as further possible reasonsCheck how long the closure lasts

For a special termination, support the reason with documents. A medical certificate or a letter about the relocation of the studio helps if the studio asks.

Is there a right of withdrawal?

Many people assume they can withdraw from a gym contract within 14 days. Under section 312g(1) BGB, however, consumers have a right of withdrawal under section 355 BGB only for two kinds of contract: contracts concluded away from business premises and distance contracts. If you signed in the studio, there is therefore no statutory right of withdrawal. If you concluded the contract online or by phone, one may exist. Under section 312g(2) no. 9 BGB there are exceptions for leisure services if the contract provides for a specific date or period. The withdrawal notice and the terms show whether this applies to your contract.

In 2016 the Hamburg consumer advice centre also recommended choosing shorter terms, because providers with monthly cancellation exist. Anyone signing a new contract should therefore look at the cancellation terms from the start.

What to clarify before writing the cancellation

Before you write the letter, clarify three things: which fees are still open, when they fall due, and how long debits continue after the termination date. Many students only notice that a monthly fee was charged for a period after the contract ended. Note your bank statements and the last debit date before you cancel.

Also ask whether the studio offers a pause or a suspension of the contract. Some providers pause memberships for a limited time, others do not. Whether this is possible is set out in the contract or the terms and conditions. A pause can make sense if you only want to stop for a semester or a stay abroad.

How do you cancel cleanly?

A clean cancellation has three parts: a clear reference to the contract, the termination date and proof that it arrived. Write briefly and factually. You do not have to give detailed reasons unless you rely on a special termination.

Keep a copy of the cancellation and proof of dispatch. If no confirmation arrives, ask within a reasonable time. If the studio keeps debiting fees, object to the debits in writing and check the transactions through your bank.

Frequently asked questions about cancelling

Can I leave early if I move house?

In 2016 the Hamburg consumer advice centre did not list moving house yourself as a reason for special termination. Whether there is an important reason under section 314 BGB depends on the circumstances. Also check the contract, because some studios offer their own rules. Without such a rule, the contract runs until the end of the term.

What happens if the cancellation arrives too late?

For pre-formulated terms, section 309 no. 9 letter b BGB allows renewal only for an indefinite period, and you must then be able to cancel at any time with at most one month’s notice. Older contracts may differ. That is why the deadline in your contract matters. Plan the cancellation with a margin and note the latest date in your calendar.

Do I have to give a reason for cancelling?

An ordinary cancellation needs no reason. A special termination, by contrast, requires you to document the important reason so that the studio can check it. Evidence is your strongest argument.

What if the studio does not respond?

Set a reasonable deadline in writing for confirmation and keep proof of arrival. If that does not help, advice from the consumer advice centre can assist. Ask your bank to check direct debits if collections continue.

What to do now

  1. Read the contract and terms: note the term, notice period and form.
  2. Check whether special termination applies and collect the evidence.
  3. Send the cancellation in writing, clearly and in a verifiable way.
  4. Wait for confirmation and monitor direct debits through your bank.
