Disability insurance for primary school teachers depends mainly on one question: will you later be a civil servant, or will you work as an employee? If you study to teach at primary level, you should keep two protection systems apart, because they overlap only partly.

Short answer: Civil servant teachers are protected by the service law of their federal state, while employed teachers often are not. Disability insurance follows the policy, and occupational incapacity follows civil service law. The rating of the teaching profession is set out in each tariff. Last updated: October 2026. Legal bases: section 172 VVG and section 26 BeamtStG.

The most important points in brief

  • Disability insurance is measured against the occupation you last practised. Incapacity for service of civil servant teachers follows the state civil service law.
  • Whether you become a civil servant depends on the federal state and the specific post. Check this with the responsible state office or ministry.
  • Whether a tariff rates the teaching profession favourably is stated in the policy conditions, not in marketing material.
  • Special rules apply during your studies and during the probationary training period, and you should check them one by one before you sign.
  • A tariff with a clear referral rule and a post-insurance guarantee often matters more to teacher trainees than the lowest premium.

How is the teaching profession rated in disability insurance?

Under section 172 (2) VVG, a person is unable to work if they can no longer, permanently and wholly or partly, practise the occupation they last carried out in the way it was shaped before the health impairment, due to illness, bodily injury or age-related loss of strength. For primary teachers, the insurer looks at the occupation description in the contract and at your actual teaching work.

Many tariffs group teachers into an occupational category set out in the conditions. Whether the tariff names primary school teachers separately, whether it refers to the type of school, and whether a referral to other activities is possible, is all written in the fine print. For this reason, do not ask only about the category. Ask for the full occupation description in writing.

Which protection applies at which stage of life?

The protection for teachers changes with each step of your career. The table shows what to check at each stage.

Stage of lifeProtection that appliesWhat to check
StudiesOnly the disability insurance, if you take one outStudent clause and the rules for moving into the profession
Probationary training (Referendariat)State service law, depending on your status also civil service lawWhether incapacity for service is regulated and what follows from it
Appointment as a civil servant on probation or for lifeIncapacity for service under the state civil service lawHow the benefit is calculated and whether supplementary disability insurance makes sense
Employed teacherNo civil service protection, so disability insurance often mattersOccupation description in the tariff, referral clause and health questions

The table does not replace a check of your individual case. It does show that disability insurance matters most when no employer or service authority covers a loss of earning capacity. More on the starting position in teacher training is in our guide Disability insurance during teacher training (in German).

What does incapacity for service mean for civil servant teachers?

Under section 26 BeamtStG, civil servants appointed for life are retired if they are permanently unfit for service. Under section 26 (1), a person who can be employed elsewhere is not retired. The state law supplements these rules for each federal state. The pension paid on incapacity follows civil service pension law and cannot be equated with a disability pension. What it would amount to for you depends on your career path and your state.

For civil servants on probation or on conditional appointment, special rules apply during the probationary training. These are set by state law, and not every rule is the same across the country. A binding answer is given by the responsible state office or the education ministry.

Worked example: when is a separate disability policy worth it?

Whether a separate policy is worth it can be checked in a few steps. The figures below are assumptions and not a calculation for your case.

  1. Find out whether you will become a civil servant after completing your training or work as an employee. Ask the state office or the school authority.
  2. Assumption: you are not appointed as a civil servant and work as an employed primary teacher. In that case, the protection of the employer or service authority does not apply.
  3. Work out your monthly needs: rent, living costs, insurance and ongoing commitments.
  4. Compare these needs with your net income and with the amount a disability pension would have to pay in an emergency. The difference shows the gap a disability policy should close.

The gap determines how high the disability pension should be. A tax adviser can help you assess how the benefit is taxed.

When does disability insurance fit, and when less so?

Disability insurance can make sense if you are not appointed as a civil servant or if you want to supplement the protection of the service authority. For many teachers it fits better when commitments already exist or a family depends on your income. It may be less suitable if you are certain to become a civil servant and have no ongoing commitments that would fall away in the event of incapacity. Whether a top-up pays off depends on your federal state, your status and your budget. A personal assessment is possible in a conversation with Academycon.

Frequently asked questions

Do I need disability insurance as a primary school teacher?

That depends on whether you will be appointed as a civil servant. Civil servant teachers are protected by the service law, while employed teachers usually are not. Disability insurance is therefore mainly important for employees, but it can also supplement the protection of civil servants in certain situations.

Does disability insurance apply during the probationary training?

A policy can be taken out during your studies, but it remains subject to its contract terms. During probationary training, the state rules apply in addition. Ask in writing what incapacity for service during the probationary training means for you.

How important is the referral clause?

It decides whether the insurer may refer you to another activity. This matters for teachers because school work can be physically and mentally demanding. More on this is in our guide Referral clause in disability insurance.

Is an employed teacher rated differently from a civil servant teacher?

The rating in the tariff depends on the contract and not on the employer. In practice, however, civil servant teachers have the protection of the service authority. Employed teachers usually have to close the gap themselves.

What if I first work as an employee after graduating?

Then a post-insurance guarantee can help to extend cover later, for example after an appointment as a civil servant or a change of career, without a new health check. Whether and under which conditions this is possible is set out in the tariff, so read the rules before you sign.

What to do now

  1. Ask your state office or school authority whether you are likely to be appointed as a civil servant after probationary training.
  2. Have the tariff’s occupation description for teachers given to you in writing and check the referral clause.
  3. Work out your coverage gap from your needs and your net income in an emergency.
  4. Compare at least three tariffs with the same checklist before you submit an application.
