A commuting accident on the way to university is one of the most common situations in which statutory accident insurance really matters for students. Anyone who falls off a bike, has an accident on the way to the bus or trips on the path in front of the lecture hall quickly wonders whether the accident insurance institution pays. The answer depends mainly on the route that was taken.

Short answer: The direct route between your home and the university is covered by statutory accident insurance, whether on foot, by bike, by bus or by car. Detours for private reasons are not covered. The accident insurance institution (Unfallkasse) pays for medical treatment and, if needed, a pension, but not for damaged property. The Most Important Points at a Glance

  • The route from your home to the university and back is covered by insurance, see § 8 SGB VII (in German) (last updated: October 2026).
  • The means of transport does not matter much: on foot, by bike, by bus or by car, the direct route is covered.
  • Detours and private stops, such as shopping, can remove the protection.
  • The accident insurance institution covers medical treatment and rehabilitation, and a pension only in case of lasting consequences.
  • Damaged items such as a bike or a laptop are not part of statutory accident insurance.

When Does the Cover Start and End on the Way to University?

Cover usually starts when you leave your home and ends when you reach the university. This applies to the entire direct route. Whether cover already starts in the stairwell or only on the street is decided by the accident insurance institution in each case. What matters is that the route serves the purpose of getting to the university, not a private errand.

The way back home is protected in the same way. Here too, the direct route counts, while deviations for private reasons do not. If you go into town after a lecture, you leave the cover.

How Are Detours and Interruptions Treated?

A detour is covered only if it is necessary because of the university, for example because a road is closed or you pick up a carpool passenger. A detour for shopping, a doctor’s appointment or an errand in town is not covered. Longer interruptions for private reasons also end the cover. The legal basis is set out in § 8 SGB VII (in German), and the accident insurance institution checks the details.

Assumption: You cycle to university and make a detour to the supermarket. If you fall on the way back from the supermarket, that is usually not covered. If you fall on the direct route, it is covered.

What Does the Accident Insurance Institution Pay After a Commuting Accident?

The accident insurance institution covers medical treatment, meaning doctor visits, hospital stays and necessary aids (§ 27 SGB VII (in German), last updated: October 2026). Rehabilitation measures are also included. A pension is paid only if the accident permanently reduces earning capacity by at least 20 percent (§ 56 SGB VII (in German), last updated: October 2026). In case of death, benefits for surviving dependants are provided. The accident insurance institution checks the claim and decides on type and scope.

The table shows typical cases. The accident insurance institution decides each case individually, because the specific circumstances matter. Property damage can be covered through liability insurance, contents insurance or bicycle insurance, as described in our guides on Insuring Laptop and Smartphone: Electronics or Contents? and Bicycle Insurance for Students: Theft in University Towns.

What Happens If I Have an Accident Under the Influence of Alcohol or Drugs?

Anyone who has an accident while under the influence of alcohol or drugs must expect reductions in benefits. The law provides for such reductions (§ 101 SGB VII (in German), last updated: October 2026). What matters is whether the condition influenced the accident. There is no blanket answer, which is why the accident insurance institution examines the case separately.

How Do I Report a Commuting Accident Correctly?

Good documentation is especially important for a commuting accident, because there is no witness in a lecture hall. Make sure the accident is reported promptly. These steps help:

  1. See a doctor immediately and say that you had the accident on the way to university.
  2. For serious injuries, go to a Durchgangsarzt (accident consultant) who specialises in accident injuries.
  3. Report the accident to the university and the competent accident insurance institution, preferably in writing.
  4. Note the time, route, means of transport and witnesses, and take photos of the scene.
  5. Keep reports, bills and all letters from the accident insurance institution.

Frequently Asked Questions

Is the route to another library on campus covered?

That depends on the purpose. A route that serves your studies, such as between a lecture hall and the library, is usually covered. A route that is mainly private is not. If in doubt, ask the university or the accident insurance institution.

Does the cover also apply to the route to a part-time job?

No, a part-time job is insured through the employer. The route to work falls under the employer’s responsibility. For students who combine both, the distinction matters, because the route to university and the route to work involve different bodies.

Does the accident insurance pay if I injure someone else on the route?

The accident insurance institution protects you, not the other person. If you injure someone else, liability insurance applies. More on this is explained in our guide on Haftpflicht im Auslandssemester.

Do I have to report a commuting accident if I am only slightly injured?

Yes, report every accident, even if the injury seems minor. Some consequences appear only later, and without an early report, a connection to the accident is harder to prove.

How to Proceed Now

  1. Know the direct route to your university and keep detours as short as possible.
  2. Report every accident early to the university and the accident insurance institution, and document it.
  3. For property damage, check whether liability insurance, contents insurance or bicycle insurance helps.
  4. Read the guide on student accident insurance for the full overview.
