Trainee civil servants who are appointed during their legal traineeship make decisions about health insurance that are hard to correct later. This guide shows the most common mistakes with the appointment on revocable terms (Beamte auf Widerruf) and private health insurance (PKV), explains the legal background and shows how to avoid them.

Short answer: The most common mistakes are not checking the legal form of your training, not matching your tariff to your state benefit rate, leaving gaps in cover, and cancelling the old contract too early. If you clarify these points before switching, you avoid most costly corrections. Last updated: October 2026.

The most important points

  • Whether you are a civil servant on revocable terms depends on your federal state. In Saxony you choose between civil service status and a training relationship, and in Thuringia the appointment is optional according to one secondary source.
  • State health benefit (Beihilfe) usually covers 50 percent for trainees without children. Your tariff for the rest must match this rate.
  • Health cost cover is mandatory in principle, but the duty lapses depending on your status. Gaps between two contracts can become expensive.
  • Cancelling the old contract only takes effect if a seamless follow-on cover with another insurer is proven.
  • Incomplete health information causes more problems than the answer itself. A move to another state changes the benefit rules.

Am I a civil servant during training?

In some states, the traineeship is not an appointment on revocable terms. According to the sources, some states give you a choice, while in others the legal form is set by law. If the training is a public-law training relationship instead of a civil service relationship, the benefit rules do not apply, and you must plan your health insurance differently.

The mistake usually lies in not asking the question at all. Clarify in writing with the training authority or the payroll office which legal form applies to you. Where no reliable source exists, the employing authority gives the binding answer.

Does my tariff match my benefit rate?

State health benefit covers a share of the eligible costs, and you must insure the rest. The share differs between states and depends on family status and children. A tariff designed for a 50 percent rest therefore does not always match your actual entitlement.

Standard case without children50 percentRule of the state benefit ordinances
Saxony with one child70 percentSecondary source, please verify
Hesse outpatient and dental care70 percentOfficial Hesse leaflet
Hesse inpatient care85 percentOfficial Hesse leaflet

Assumption: an eligible invoice amounts to 1,000 euros. At 50 percent state benefit, 500 euros remain with you. At 70 percent, only 300 euros remain. A tariff sized for 500 euros then costs unnecessary contributions, while a tariff sized for 300 euros leaves a gap at 50 percent.

What happens with a gap in cover?

Under section 193 paragraph 3 of the Insurance Contract Act (VVG), anyone with a residence in Germany must insure against illness costs. The duty lapses for people entitled to state health benefit and for statutorily insured people. Anyone who has no cover between the final exams and the traineeship may fall into a gap, because the benefit entitlement does not yet exist.

If the contract is requested more than one month after the duty began, a premium surcharge applies under section 193 paragraph 4. It amounts to one monthly premium for each started month without insurance. From the sixth month onward, one sixth applies for each further started month, and without proof a period of at least five years is assumed.

Assumption: your monthly premium is 200 euros and you are four months without a contract although a duty exists. You then pay a one-off surcharge of four monthly premiums, that is 800 euros, on top of the ongoing contributions. Gaps are therefore much more expensive than applying on time.

When may I cancel my old contract?

Under section 205 paragraph 6 of the Insurance Contract Act, a contract that fulfils the duty may only be cancelled if a new contract that meets the duty is concluded with another insurer. The cancellation only takes effect if seamless continuation with a new insurer is proven within two months of the cancellation notice.

The most common mistake is cancelling before the new contract is concluded. Conclude the new contract first, get its start confirmed in writing and cancel afterwards. A tariff change within the same insurer follows separate rules and is not the same as switching to another insurer.

What must I observe with health questions?

When you apply, you must answer health questions completely and truthfully. This follows from section 19 of the Insurance Contract Act (VVG). Anyone who hides pre-existing conditions risks benefit refusals or an adjustment of the contract later. In case of doubt, a precise answer with medical findings is better than a brief one.

Note also that insurers may agree exclusions or surcharges for certain pre-existing conditions. Ask for the terms in writing and compare them with the answers you gave.

What changes with a move to another state?

When the employer or the federal state changes, the benefit rules of the new employer apply. Under the Bremen rules of 2019, the former state no longer contributes to health insurance costs afterwards. A lump sum you chose in one state may therefore look very different in the new state or may not apply at all.

Plan a move early. Clarify with the new payroll office which benefit applies, and adjust your tariff before the move takes effect.

Frequently asked questions

Can I change my private tariff during the traineeship?

Usually yes. A tariff change within the same insurer follows its own rules. A switch to another insurer is tied to a seamless follow-on cover under section 205 paragraph 6 of the Insurance Contract Act when a duty exists. Check beforehand whether the new tariff matches your benefit rate.

What is a premium surcharge?

A premium surcharge is a one-off payment that applies when a contract is requested long after the duty began. It depends on the length of the period without insurance and is set by law. You avoid it by applying on time.

Does the same apply to the appointment for life?

The principles are similar, but the transition is a separate step. Our guide on appointment on probation with PKV and state benefit explains what comes next after the traineeship.

Where can I get reliable information?

The payroll office, the benefit office and the training authority of your state answer questions on benefits and legal form. You can request individual advice on your situation from Academycon, with details on the page how we work (in German).

What to do now

  1. Clarify in writing with the training authority whether your traineeship is an appointment on revocable terms.
  2. Calculate your benefit rate for your family status and align the tariff for the rest with it.
  3. Conclude the new contract before cancelling the old one, and apply within one month.
  4. Keep all proof of seamless continuation and submit it on time.
